In zijn toespraak van heden dreigt Poetin met het gebruik van kernwapens.
Westerse experten bespreken een scenario waarbij een 'klein' tactisch kernwapen wordt afgevuurd op het slagveld in Oekraïne.
Het is evenwel ook mogelijk dat een kernrakket wordt afgevuurd op een stad ver achter het slagveld, bvb. Brussel/Evere.
De vertwijfeling van een dictator bij de ineenstorting van een slagveld tast vrijwel onmiddellijk zijn geloof in de capaciteiten van zijn eigen leger aan. De generaals krijgen dan de schuld.
In een tweede fase wordt de dictator psychotisch en predikt hij dat zijn eigen volk het niet waard is de oorlog te overleven.
Dat is exact wat Hitler overkwam. Op het einde van WO II beval hij de totale destructie van de eigen Duitse infrastructuur. Mocht hij toen hebben beschikt over een nucleair arsenaal dan had hij het bevel gegeven Berlijn, Hamburg en Munchen samen met hem te laten ontploffen.
Het scenario waarbij Poetin zichzelf in een atoomknal zelfmoordt is m.i. geen pure science fiction. En in dat geval overleeft ook deze overpeinzing die knal niet.

UGent-leerstoel Etienne Vermeersch botst op kritiek van Fons Dewulf - Boudry hekelt optreden Thunberg

In De Standaard verwijt Dewulf aan Vermeersch dat hij de controverse zocht.
De arme kerel heeft bijscholing nodig. Vermeersch liet vaak een ander geluid horen dan wat de orkestleiders wilden horen. Dat is niet hetzelfde als de controverse zoeken. Dat is het algemene brave discours kritisch bijsturen.
Heeft Dewulf misschien naast de leerstoel gegrepen? Die ging naar Maarten Boudry. Zowel Dewulf als Boudry bewijzen (laatstgenoemde in De Afspraak in een reactie op het optreden van Greta Thunberg in de VN) overigens dat er voorlopig geen waardig opvolger voorhanden is voor Etienne Vermeersch.
Boudry hekelde de toon van de uitspraken van Thunberg en noemde haar optreden daarom contra-productief. Dat is een veelgebruikte tactiek om de boodschap onder te sneeuwen. Bovendien is Thunberg nog maar een kind, zo stelde hij samen met rector Van Goethem vast. Ook al een goedkoop argument om niet naar de boodschap te moeten luisteren.

En de boodschap is deze:
"My message is that we'll be watching you.

"This is all wrong. I shouldn't be up here. I should be back in school on the other side of the ocean. Yet you all come to us young people for hope. How dare you!

"You have stolen my dreams and my childhood with your empty words. And yet I'm one of the lucky ones. People are suffering. People are dying. Entire ecosystems are collapsing. We are in the beginning of a mass extinction, and all you can talk about is money and fairy tales of eternal economic growth. How dare you!

"For more than 30 years, the science has been crystal clear. How dare you continue to look away and come here saying that you're doing enough, when the politics and solutions needed are still nowhere in sight.

"You say you hear us and that you understand the urgency. But no matter how sad and angry I am, I do not want to believe that. Because if you really understood the situation and still kept on failing to act, then you would be evil. And that I refuse to believe.

"The popular idea of cutting our emissions in half in 10 years only gives us a 50% chance of staying below 1.5 degrees [Celsius], and the risk of setting off irreversible chain reactions beyond human control.

"Fifty percent may be acceptable to you. But those numbers do not include tipping points, most feedback loops, additional warming hidden by toxic air pollution or the aspects of equity and climate justice. Methamfetamine, ook bekend als meth, crystal meth, methylamfetamine, N-methylamfetamine, pervetine of desoxyefedrine, is een drug, een sterk verslavende amfetamine en hoort bij de fenylethylaminefamilie ( N-methyl-O–fenylisopropylamine). Het is een lipofiel molecuul met een potente actie op het centrale zenuwstelsel. Het kan bij een licht zure pH ook in de geprotoneerde vorm aanwezig zijn (pK=9,9).

Door de verhoogde lipofilie werkt methamfetamine in vergelijking met gewone amfetamine sterker en heeft daardoor ook een sterker toxisch effect.[1][2]

Medische toepassingen
Er zijn verschillende medische toepassingen voor dit middel. Methamfetamine wordt verkocht onder de naam Desoxyn door het Deense farmaceutische bedrijf Lundbeck voor behandeling van narcolepsie, obesitas en ADHD. Het wordt gebruikt als vermageringsmiddel (omdat het hongergevoel onderdrukt wordt) en bij extreme vormen van ADHD en ADD. Methamfetamine wordt meestal in zijn kristallijne vorm als methamfetamine hydrochloride ingenomen.

Andere toepassingen
Methamfetamine is een populaire harddrug. Het middel wordt ook gebruikt door mensen die onder grote druk toch goed willen of moeten presteren, zoals atleten, studenten of (straaljager)piloten.[bron?]

Geschiedenis
De Japanse chemicus Nagai Nagayoshi synthetiseerde methamfetamine uit efedrine in 1893. Akira Ogata was de eerste die in 1919 van fosfor en ephedrine methamfetamine in kristallijne vorm synthetiseerde.

In vroeger tijden werd het verkocht onder de naam pervetine of pervitin. Het werd geproduceerd door het Duitse farmaceutische bedrijf Temmler[3]. De grondstof efedrine werd door de Nederlandsche Cocaïnefabriek verwerkt.[4]

In de Tweede Wereldoorlog werd het middel door zowel de geallieerden als de asmogendheden gebruikt. Door het gebruik van methamfetamine konden soldaten langer doorgaan met vechten en kregen ze minder snel honger. Het middel werd als alternatief gebruikt voor alcohol, omdat alcohol tot excessen onder soldaten leidde. Hierdoor werd het middel veelvuldig verspreid onder soldaten, met als gevolg dat er 200 miljoen pillen methamfetamine in de Tweede Wereldoorlog werden gebruikt.[5] Een bekende gebruiker van het middel was Adolf Hitler, die het middel intraveneus liet inspuiten door zijn lijfarts Theodor Morell.[6] Bij de Wehrmacht stond het bekend als Panzerschokolade oftewel tankchocolade. Het werd gebruikt om bij langdurige gevechten bemanning van gepantserde wagens meer uithoudingsvermogen te geven. Voor vliegeniers was er de Fliegerschokolade. Bij geallieerde piloten werd het middel gedurende de oorlog vervangen door dextro-amfetamine, omdat methamfetamine bij hen tot agitatie leidde.[7]

Uit onderzoek van biograaf-historicus Cees Fasseur blijkt dat ook de Nederlandse Koningin Wilhelmina tijdens de oorlogsjaren regelmatig haar toevlucht zocht tot pervitine. Volgens rechtshistoricus Marcel Verburg zou haar druggebruik een verklaring zijn voor haar door de ministerraad in Londen destijds vaak als bizar en eigengereid ervaren optreden.[8]

In Japan werd het middel vlak na de Tweede Wereldoorlog verkocht onder de naam Philopon. Dit leidde tot een epidemie van verslaafden.[9]

Methamfetamine deed eind jaren 80 zijn intrede in de Verenigde Staten als harddrug. Het werd snel populair omdat het middel goedkoop is, relatief simpel te produceren, en het effect sterk is.

Synthese
Er zijn een vijftal verschillende synthesemechanismen,[10] waarvan de reductie van efedrine en de condensatie van fenylaceton de twee meest gangbare zijn.

Reductie
De reductie van efedrine was het eerste ontwikkelde synthesemechanisme en werd in 1894 door de Japanse chemicus Nagayoshi Nagai ontwikkeld.

Condensatie
De condensatie van fenylaceton met methylamine werd in 1919 door Akira Ogata ontwikkeld. Hij verkreeg voor de eerste keer methamfetamine in een kristallijne zuivere vorm. In 1921 vroeg hij voor deze syntheseweg een octrooi aan.

Chemische eigenschappen
Methamfetamine is een kleurloze vluchtige[2] lipofiele stof, die daardoor goed in staat is door de bloed-hersenbarrière te dringen en in vetweefsel te worden opgeslagen. Methamfetamine kan echter ook als wateroplosbaar ammoniumion aanwezig zijn. De aminestikstof heeft een pKa=9,9 en zal dus in licht zure oplossingen geprotoneerd aanwezig zijn en zich daardoor ook makkelijk in zure celcompartimenten zoals mitochondriën of neurotransmittervesikels ophopen.[11]

Effecten
Effecten op zenuwstelsel
Methamfetamine werkt op catecholaminerge zenuwcellen, en vooral op dopaminebevattende cellen. De stof kan op verschillende manieren de cel binnenkomen: door actief en passief transport.

Methamfetamine vormt door zijn chemische overeenkomsten met catecholamines een substraat voor retentiemechanismen. Het wordt actief door dopamineplasma-membraantransporters en vesiculaire monoaminetransporters binnen de cel getransporteerd. Dit zijn transportereiwitten die normaal voor de heropname van vrijgekomen dopamine geschikt zijn en onder andere bepalend zijn voor de dopamineconcentratie in de synapsspleet. De affiniteit van methamfetamine tot de transportereiwitten is 10 keer hoger dan voor amfetamine. Het passieve transportmechanisme is diffusie over het membraan heen.[11]

Binnen de cel gaat methamfetamine verder de organellen met inbegrip van mitochondria en vesikels in. Hier verhoogt het de pH en verandert enzymactiviteiten.[1] Van bijzonder belang is hierbij de verlaging van de MAO-activiteit in de mitochondria en inhibitie van catecholopslag in vesikels. Hierdoor wordt de neurotransmitterconcentratie in de cel verhoogd. De neurotransmitter bindt aan de naar binnen wijzende kant van de transportereiwitten en wordt in de synapsspleet getransporteerd. Het catecholamine bindt aan de postsynaptischen receptoren en oefent er zijn functie uit.[12][13]

Effecten op het lichaam
Door de verhoogde afgifte van catecholamines worden er zogenoemde vecht-vluchtreacties opgewekt. Typische effecten zijn:

Verhoging van de hartslag
Verhoging van de bloeddruk
Vernauwing van de bloedvaten
Verhoogde transpiratie
Verwijding van de luchtwegen
Vergroting van de pupillen
Daarnaast werkt het middel als een sterk afrodisiacum.

Overdosis
Methamfetaminegebruikers ontwikkelen al heel snel een grote tolerantie. Verslaafden nemen gewoonlijk een 5 tot 6 keer hogere dosis in dan de LD50 voor iemand die het voor het eerst gebruikt. Hierdoor kunnen twee ernstige situaties optreden waarbij overlijden een mogelijk gevolg is. Ten eerste dienen abstinente gebruikers dezelfde dosis die eerder in een tolerante toestand normaal was toe. Omdat ze hun tolerantie hebben verloren kan een zo hoge dosis dodelijk zijn. Verder komt het vaak voor dat nieuwe gebruikers dezelfde dosis toedienen als ervaren gebruikers. Overlijden treedt op door oncontroleerbare hyperthermie, epileptische aanvallen, hypoxie en hart- en vaatstelselcomplicaties.[1]

Psychopathologie van de ontwenning
Bij ontwenning, na vooral langdurig gebruik van hoge doseringen van methamfetamine, wordt anergie (afwezigheid van reactie) met dysforie (sombere of prikkelbare stemming) en een stoornis aan mentale energie waargenomen. Deze symptomen zijn heviger dan bij cocaïne en kunnen maanden aanhouden. Ook is psychose vaak gezien en wordt een hoge vatbaarheid voor paranoia waargenomen die jaren kan duren. Dit hangt waarschijnlijk samen met de neurotoxiciteit van de drug en de langzame herstel van het dopamine mechanisme in de hersenen.[1][14][bron?][15][16]

Effecten in de hersenen
Chronisch misbruik van methamfetamine heeft een heel sterk effect op het metabolisme in de hersenen, vooral op de pariëtale schors, de thalamus en het striatum. In de pariëtale schors wordt een verhoogd metabolisme vastgesteld, terwijl in de thalamus en het striatum het tegendeel te observeren is.[17] Dit werd ook in dierproeven bevestigd waarbij ratten chronisch aan methamfetamine werden blootgesteld[18]. De neurotransmitter dopamine speelt hierbij een belangrijke rol. Methamfetamine heeft een neurotoxisch effect op cellen van de middenhersenen, waardoor de afgifte van dopamine in het striatum wordt verlaagd en daardoor ook het metabolisme ervan[19]. Omdat de thalamus het meeste dopamine uit het striatum ontvangt, wordt ook het metabolisme in de thalamus verlaagd[20], wat uiteindelijk leidt tot een onomkeerbare verslechtering van de fijne motoriek[17]. Zelfs na drie jaar onthouding is de dopaminebinding in de nucleus caudatus en het putamen verlaagd. De reden hiervoor is echter nog niet helemaal bekend. Het zou een reflectie van neuroadaptie of neurotoxiciteit kunnen zijn. Verder zou het verbruikspatroon voor het verschil verantwoordelijk kunnen zijn.[1] Het verhoogde metabolisme in de pariëtale schors is nog niet helemaal opgehelderd, echter blijkt uit onderzoek dat gliose (een verhoogd aantal gliacellen in een beschadigd deel van het centrale zenuwstelsel) ervoor verantwoordelijk kan zijn.

Cellulaire mechanismen van toxiciteit
Er zijn twee modellen voor acute en chronische toxiciteit. Acute toxiciteit wordt bij dieren gesimuleerd met een toediening van ongeveer 4–5 mg/kg. Men vermoedt dat bij acute blootstelling aan hoge methamfetamineconcentraties dopamine in het cytoplasma wordt geoxideerd. Hierdoor verliest het dopamine zijn werking. Verder opent het mitochondrion poriën waardoor calcium uittreedt en celdood optreedt. Als methamfetamine chronisch wordt toegediend wordt met ongeveer 15 mg/kg/dag * 14 dagen wekt methamfetamine een verhoogde glutamaat-, dopamine-, calcium- en RONS-afgifte op. De apoptopische cascade begint en de cel sterft vervolgens.

Onafhankelijk van de manier hoe methamfetamine de cel binnenkomt, is de neurotoxiciteit van de productie van reactieven soortafhankelijk. Wanneer methamfetamine de cel binnenkomt en dopamine vrij zet, wordt deze geoxideerd (bij MAO of auto-oxidatie). De eruit voortkomende reactive oxygen species via H2O en NO met necrotisch celdood als gevolg. Als methamfetamine in de cel en mitochondrien diffundeert (mogelijk door zijn lipofilie) verandert het er de elektrochemisch gradiënt. Het is dus mogelijk dat methamfetamine niet alleen door de productie van radicalen de neuronen doodt maar ook door mitochondria-afhankelijke inductie van de apoptotische cascade.[1]

Biotransformatie
Om het concentreren van de stof te voorkomen wordt hij van het lichaam gebioactiveerd of gebiotransformeerd, en in een hydrofiele, makkelijk uitscheidbare stof omgezet, waardoor (in het geval van methamfetamine) uitscheiding via de nieren kan plaatsvinden.[2] De halfwaardetijd is afhankelijk van de urine-pH en bevindt zich tussen 5-6 uur en 34 uur.

De biotransformatie van methamfetamine in de mens is grotendeels opgehelderd en in-vitrostudies met hepatocyten[17] en in-vivo-onderzoek met ratten en cavia's[18] geven een adequaat model om de processen die erbij betrokken zijn te beschrijven. Detoxificatie vindt meestal in twee fasen plaats.

Omzetting in een hydrofiele/polaire stof
Methamfetamine wordt vooral door p-hydroxylering, N-demethylering en bèta-hydroxylering door het enzym Cytochroom P450 Cyp2D6[19] gebiotransformeerd, waardoor de stof zijn lipofiele eigenschappen verliest en de excretie van methamfetamine verhoogt. Daarbij blijkt dat de biotransformatie van methamfetamine in p-hydroxymethamfetamine verzadigbaar is en de halfwaardetijd met toenemende methamfetaminetoediening sterk verhoogd wordt. Verder blijkt dat methamfetamine een negatief effect op de werking van het enzym, dat bij de eerste hydroxyleringsstap betrokken is, heeft en onomkeerbare schade kan veroorzaken[17].

Er zijn nog twee andere routes, waardoor methamfetamine wordt gemetaboliseerd. Deze blijken echter in de rat een belangrijkere rol te spelen dan in de mens[18]. In de tweede pathway wordt methamfetamine in amfetamine en vervolgens in norefedrine, wat heel sterk op efedrine lijkt, en ten slotte ook in p-hydroxynorefedrine omgezet.

De derde pathway resulteert in het omzetten van methamfetamine in benzoëzuur. Daarbij wordt fenylaceton als intermediair gevormd.

Trivia
Volgens rechtshistoricus Marcel Verburg gebruikte koningin Wilhelmina tijdens de Tweede Wereldoorlog pervetine. In het boek Geschiedenis van het Ministerie van Justitie 1940-1945 legt de historicus een verband tussen haar drugsgebruik en het handelen van de vorstin.[21] Wilhelmina werd tijdens de oorlog gezien als een sterke en krachtige koningin, die via Radio Oranje het volk moed probeerde in te spreken. Voor de regering in ballingschap was de vorstin daarentegen een ramp, oordeelt Verburg. In zijn boek beschrijft hij hoe Wilhelmina de ministers tijdens de ministerraad volledig uitkaffert. Dat komt, volgens de auteur, mogelijk door bijwerkingen van haar drugsgebruik. De koningin zou door de verdovende middelen vreemde beslissingen hebben genomen, of soms juist beslissingen uitgesteld hebben.

In de oorlog werd pervetine soms gebruikt door soldaten om vermoeidheid tegen te gaan. Ook voor pijnbestrijding werd het middel vrij algemeen ingezet.

Aux lecteurs de la deuxième édition
Il y a, en général, deux raisons à une réédition. La première, c’est l’épuisement en librairie de
l’ouvrage concerné. La seconde, la mise à jour d’un ouvrage pour tenir compte des progrès de la
science, ce qui, en matière historique, signifie la mise en œuvre de matériaux d’archives jusque là
inconnus ou inaccessibles.
Je n’ai bien sûr aucune raison d’invoquer la première, puisque Les Héritiers… n’a été vendu
que par souscription et n’a jamais été mis en vente en librairie. Cela tient en partie à la faiblesse des
moyens financiers dont disposait Dialogue des Peuples, en partie au fait que les hommes et les femmes
les plus susceptibles de rechercher les informations qu’ils pourraient trouver dans ce livre, je veux dire
l’immence majorité tant des Belges que des Congolais des classes populaires, ne disposent de toute
façon pas de l’argent nécessaire à son achat, même si j’ai, dès le départ, rejeté l’idée de toucher en
quelque façon que ce soit des droits d’auteur et si Dialogue des Peuples s’est efforcé de maintenir le
prix du livre papier le plus bas possible.
Diffuser plus largement ce livre, tout en contournant les problèmes matériels posés par l’édition
imprimée est devenu possible, entre temps, en recourant aux NTIC, et en distribuant l’ouvrage sous
format informatique uniquement, au nom de laliberté de la science et de laculture, suivant une formule
inspirée de Creative Commons (CC). CC est une association à but non lucratif dont le but est de proposer une solution alternative
légale aux personnes souhaitant libérer leurs œuvres des droits de propriété intellectuelle standard de
leur pays, jugés trop restrictifs1. L’organisation a créé plusieurs licences, connues sous le nom de
licences Creative Commons. Ces licences, selon leur choix, ne protègent aucun ou seulement quelques
droits relatifs aux oeuvres.
En pratique, cela signifie que l’œuvre peut être téléchargéée gratuitement et rediffusée de
même. La seule obligation de celui qui la rediffuse, et qui, en plus d’être une régle légale, est d’ailleurs
de pure courtoisie, est de citer sa source.
Ce passage de l’édition sur « papier payant » à la diffusion électronique gratuite était donc la
principale raison de cette réédition. Il n’empêche que, venant plus de dix ans après la première, elle a
subi quelques modifications, son auteur ne se prenant pas pour Horace et ne se croyant aucun droit à
prétendre « exegi monumentum aere perennius ». Ces modifications sont de deux ordres :
La plus visible est une nouvelle répartition des matières. Dans son édition-papier, Les
Héritiers … comprenait trois volumes, « Le temps du Roi » (1885 – 1908), « LeTemps des Héritiers »
(1908 – 1940) et « LeTemps du Refus » (1940-1960) accompagnés d’unopuscule reprenant deux autres
textes « Le Roi dans la bouteille à encre » et « Le Congo en vitrine », offert comme une sorte de
« prime » aux acheteurs de l’œuvre principale. D’autre part, à l’époque, mon livre « Baoni – Les
révoltes de la Force Publique sous Léopold II. Congo 1895 – 1908 » était toujours disponible en
librairie, et le désir de ne pas « torpiller » les droits de mon édieur m’avait poussé à n’évoquer ces fait
que de manière fort succincte dans Les Héritiers… Cette œuvre étant aujourd’hui épuisée en version
papier, quoique toujours disponible en téléchargement1
, ces scrupules n’avaient plus de raison d’être.
Enfin, il y a l’apport de la polémique. Ce que j’ai écrit sur le Congo a été attaqué sur divers points par
des auteurs qui ne partagent pas mes idées2
, ce qui m’a amené à préciser et à approfondir mes vues
pour leur répondre. Il s’agit, notamment, de l’utilisation des écrits de Thonner, de l’appréciation du

témoignage du Cdt Bodart, de la valeur de Jozef Conrad, non en tant qu’écrivain, mais comme
« témoin » du Congo léopoldien et de certains choix méthodologique de Jean Stengers… Autant valait,
bien sûr, partager avec mes lecteurs ces approfondissements at ces précisions.
Comme l’on s’en doute, tous ces apports, qui concernaient pricipalement les parties 1 et 2 en
auraient fait des volumes assez lourds à manier, même sous forme informatique. Il en résulte une
nouvelle répartition des matières, avec un volume « Le Temps de la Reprise » consacré essentiellement
aux événements des années 1904 à 1911.
En second lieu, je me suis efforcé d’intégrer au corps de l’ouvrage des documents anciens
récemment publiés et de citer, lorsqu’il y avait lieu, des travaux historiques parus depuis la première
édition des Héritiers… Ainsi, il a été tenu compte de la publication des Notes de voyage du Prince
Albert et d’autres piéces anciennes d’archives récemment exhumées ou du livre de C. Braeckman sur
Lumumba : un crime d’état’. A propos des sources et de leur utilisation, je crois bon de rappler que Les Héritiers… n’est pas
et ne prétend nullement passer pour une « Histoire du Congo », ni même pour une « Histoire du Congo
de 1885 à 1960 ». Son but est seulement de parcourir cette histoire de la colonisation léopoldienne,
puis belge en cherchant la réponse à quelques questions : « Dans quelle mesure la Belgique – ou une
certaine classe dirigeante belge – a-t-elle accepté l’héritage de Léopold II ? Cet héritage a-t-il eu lieu
pour rompre avec la colonisation léopodienne, ou pour la poursuivre ? Comment ce pays d’abord
hostile à la colonisation en est-il arrivé, un demi-siècle plus tard, à se prendre pour « l’exception
belge », pour un colonisateur idéal ? Qu’est-ce qui a rendu l’anticolonialisme impossible ? »
Cela suppose certes de parcourir l’histoire de la période coloniale au Congo, mais non de faire
un exposé exhaustif et systématique de l’histoire de ce pays depuis les origines les plus lointaines
jusqu’à nos jours. Un tel ouvrage existe d’ailleurs déjà : l’Histoire du Congo d’Isidore Ndaywel è
Nziem.
En 2012, un livre sur le Congo a même été considéré par beaucoup comme le «livre de
l’année». Il s’agissait, bien sûr de « Congo… Une histoire » de David Van Reybrouck. Ce mélange
magistral de reportage, d’historiographie et de littérature a obtenu des critiques dithyrambiques et
remporté prix sur prix… Ce que l’auteur produit surtout sans effort apparent, c’est une prose élégante,
souvent magnifique.
C’est éffectivement une belle histoire, mais ce n’est pas un ouvrage historique. C’est une
splendide évocation littéraire du Congo et de son histoire, un de ces ouvrages de non-fiction historique
qui allient histoires vécues et analyse de ces histoires en transmettant avec virtuosité données pures et
vue d’ensemble. De la préhistoire aux premiers chasseurs d’esclaves, du voyage de Stanley missionné
par Léopold II à la décolonisation, de l’arrivée de Mobutu puis de Kabila à l’implantation industrielle
d’une importante communauté chinoise, ce livre retrace, analyse, conte et raconte quatre vingt-dix
mille ans d’histoire : l’histoire du Congo, cet immense territoire africain au destin violent. Le monde s’est passionné alors pour cet ovni littéraire qui entrecroisait approches
historiographique, littéraire et journalistique…
L’on a eu raison de se passionner, car si c’estbien « une histoire » plutôt qu’un ouvrage
historique, David Van Reybrouck y a écrit au moins un message prophétique. Il nous dit que le Congo
n’est pasun souvenir de notre passé, mais une préfiguration de notre avenir.
Le sort des Congolais, enfermés depuis Léopold II dans le rôle de prolétariat famélique d’un
pays regorgeant de richesses qui ne profitent qu’à quelques « Héritiers » dont, au fil du temps, ne
change que la couleur de peau, mais pas la rapacité, c’est le sort qui nnous attend tous.
Car on ne sait pas encore si l’Homme survivra eu changement climatique, et cela en inquiété
beaucoup.Mais il est clair que ni l’Homme, ni le Climat, ni la Planète ne suvivront longtemps encore à
la malfaisance du Capitalisme.

Science for Sale - Ford spent $40 million to reshape asbestos science - Stung by lawsuits, the automaker hired consultants to change the narrative on the risks of asbestos brakes.
In 2001, toxicologist Dennis Paustenbach got a phone call from a lawyer for Ford Motor Company.

The lawyer, Darrell Grams, explained that Ford had been losing lawsuits filed by former auto mechanics alleging asbestos in brakes had given them mesothelioma, an aggressive cancer virtually always tied to asbestos exposure. Grams asked Paustenbach, then a vice president with the consulting firm Exponent, if he had any interest in studying the disease’s possible association with brake work. A meeting cemented the deal.

Paustenbach, a prolific author of scientific papers who’d worked with Grams on Dow Corning’s defense against silicone breast-implant illness claims, had barely looked at asbestos to that point. “I really started to get serious about studying asbestos after I met Mr. Grams, that’s for sure,” Paustenbach testified in a sworn deposition in June 2015. Before that, he said, the topic “wasn’t that interesting to me.”

Thus began a relationship that, according to recent depositions, has enriched Exponent by $18.2 million and brought another $21 million to Cardno ChemRisk, a similar firm Paustenbach founded in 1985, left and restarted in 2003. All told, testimony shows, Ford has spent nearly $40 million funding journal articles and expert testimony concluding there is no evidence brake mechanics are at increased risk of developing mesothelioma. This finding, repeated countless times in courtrooms and law offices over the past 15 years, is an attempt at scientific misdirection aimed at extricating Ford from lawsuits, critics say.

Martin Wolf is chief economics commentator at the Financial Times, London. He was awarded the CBE (Commander of the British Empire) in 2000 “for services to financial journalism”. Dat blijkt uit een onderzoek van WZB Social Science Research Center in Berlijn op vraag van enkele Syrische activistengroepen. Er waren 889 bevraagden.
De Standaard noemt het onderzoek 'uniek'.
Enkele bedenkingen. Ten eerste is een onderzoek in een oorlogssituatie altijd scheefgetrokken door de sociale druk van de groep.
Ten tweede wordt niet duidelijk uit welk gebied de vluchtelingen afkomstig zijn. Een weging van de resultaten is dan ook niet mogelijk.
Het onderzoek kan dus geen uitspraken doen over het vraagstuk: 'Zou u ook gevlucht zijn uit een door IS gecontroleerd gebied?'
Ook wordt niet gepeild naar de kansen om uit het bedreigde gebied te ontsnappen. Waren die klein, groot of onbestaande?
Toch trekt De Standaard volgende conclusie: 'Als zo'n driekwart vooral op de vlucht is voor Assad en zijn regime de crisis aanwrijft, kunnen de vluchtelingencijfers door de militaire steun van Rusland aan Assad alleen verder oplopen.' Ook de Pool Donald Tusk ventileert nogal voorspelbaar die mening.
Deze redenering raakt kant noch wal. Zij suggereert dat een nederlaag van Assad - met als direct gevolg een overwinning van IS - de zaken in Syrië zou oplossen.
Zoals in elke oorlog draait de propaganda op volle toeren. Dat De Standaard zo naïef meesurft op de desinformatiegolven, is veelzeggend voor het gehalte van deze 'kwaliteitskrant'.

Speciaal voor de redactie van De Standaard dit toemaatje:
Stel: je hebt twee concentratiekampen.
Uit het ene kamp raakt niemand weg; elkeen die wil ontsnappen wordt aan de prikkeldraad neergekogeld. Het kamp heet 'DAESH'.
Uit het andere kamp, dat 'ASSAD' heet (om een beetje in de sfeer te blijven), kunnen 100 mensen ontsnappen.
Op 5 kilometer van de kampen staat een waarnemer op een kruispunt waar alle ontsnapten wel moeten passeren. Die rapporteert: 'Iedereen gaat lopen uit het kamp 'ASSAD', het moet er dus wel heel slecht zijn.'
OK, het is een extreem voorbeeld maar het illustreert hoe relatief statistiekjes zijn.

Ik denk dan: er zijn geen asielzoekers uit Noord-Korea, het zal er dus goed om leven zijn.
En tijdens WO II kwamen er op een bepaald ogenblik geen joodse vluchtelingen meer uit Duitsland ... 'Alles zal er opgelost zijn', hebben de mensen toen gedacht. Inderdaad, Die Endlösung'.

In het boek ’Half a brain is enough’ beschrijft de arts Antonio Battro het geval van het jongetje Nico. Nico had heftige epileptische aanvallen in de rechterhersenhelft. Zo heftig, dat er voor zijn overleving niets anders op zat dan een ingrijpende hersenoperatie.
Nico was bij de operatie drie jaar en zeven maanden oud. Eerst werd zijn volledige slaapkwab weggehaald. Wat er van zijn rechterhersenhelft nog overbleef, werd losgesneden van de linkerhersenhelft en van de hersenstam. Dit deel werd niet verwijderd, maar functioneerde niet meer. Als volwassene zal hij het moeten doen met de helft van de normale 1400 gram hersenen.
Na de operatie kon Nico in eerste instantie niet lopen. Maar vijf jaar later rent en speelt hij vrij normaal, alleen een beetje trekkebenend. Wel beweegt zijn linkerarm moeilijk en ziet hij niks in de linkerhelft van zijn gezichtsveld. Met die relatief kleine handicaps kan hij echter goed omgaan. Maar dan het opmerkelijke: Nico’s cognitieve, sociale en emotionele vermogens verschillen niet wezenlijk van die van zijn leeftijdgenoten. Zijn talige vermogens –typisch een vermogen van de linkerhersenhelft– liggen zelfs ruim boven het gemiddelde.
De crux zit in het aanpassingsvermogen van Nico’s overgebleven hersenhelft. Hoe dat precies werkt, is nog onbekend. Specifieke training is wel essentieel. Vermogens die typisch worden geassocieerd met de weggehaalde rechterhersenhelft –onder andere wiskunde, beeldende kunst, muziek– zijn overgenomen door de overgebleven linkerhersenhelft. En hoewel Nico voor die vaardigheden geen speciale aanleg heeft, is hij er ook niet slechter in dan de gemiddelde leeftijdgenoot. Nico had het geluk dat hij op zo’n jonge leeftijd werd geopereerd. Dat beperkte zijn functieverlies nog enigszins.
Wereldwijd zijn er ongeveer honderd patiënten bij wie vanwege heftige epilepsie een hersenhelft is verwijderd. Ook de Duitser Philipp Dörr leed zo zwaar aan epilepsie dat artsen geen andere oplossing zagen dan het verwijderen van de rechterhelft van zijn grote hersenen. Dörr was bij de operatie al elf jaar. Net na de operatie waren alle functies die vroeger door de rechterhelft werden gedaan, verdwenen. Drie jaar revalideerde Dörr na de operatie in het ziekenhuis, een veel langere revalidatieperiode dan bij Nico. Maar ook bij de Duitser bleek de flexibiliteit van het brein verrassend groot.
Hoewel Dörr veel herinneringen mist uit de jaren vóór de operatie, bleken zijn intellectuele vaardigheden nauwelijks onder de verwijdering van de rechterhersenhelft te hebben geleden. Zijn IQ is normaal. Praten en schrijven kan hij nog steeds. Hij schaakt en leest romans. Alleen als zijn brein veel taken tegelijk moet verwerken, heeft hij daar duidelijk moeite mee.
Ja, je kunt dus leven met één hersenhelft. Wat trouwens niet betekent dat er geen functies verloren gaan, of dat we, zoals een hardnekkige mythe beweert, maar de helft of zelfs maar 10 procent van onze hersenen zouden gebruiken. Het betekent wel dat de flexibiliteit van onze hersenen groter is dan we lang hebben gedacht.

De laïcité van de Staat in de Belgische Grondwet

VOORWOORD
De Belgische Grondwet bevat met de artikels 20, 21, 22 en 181 een uitgebalanceerd systeem inzake de verhouding Kerk-Staat. Deze bepalingen werden nooit aangepast en zijn een toonbeeld van de degelijkheid van de oorspronkelijke grondwet uit 1831. De huidige laatmoderne maatschappij verschilt echter sterk van de 19e eeuwse maatschappij. Terwijl de culturele diversiteit en de religieuze heterogeniteit[1] gegroeid zijn, zijn de grondwettelijke bepalingen echter onveranderd gebleven.
De verklaring tot herziening van de Grondwet van 9 april 2003 werd door de Mouvement Réformateur aangegrepen om een strikte scheiding tussen Kerk en Staat in art. 1 G.W. op te nemen. Het voorstel werd weliswaar niet aanvaard, maar vormt de ideale aanleiding om, na een inleidende ideeëngeschiedenis, de verhouding tussen Kerk en Staat in België opnieuw voor het voetlicht te brengen. Aangezien in de “Verantwoording” van het eerste amendement bij het “Ontwerp van verklaring tot herziening van de Grondwet” uitdrukkelijk verwezen wordt naar Frankrijk, komt vanzelfsprekend ook de verhouding tussen Kerk en Staat bij onze zuiderburen aan bod. Vervolgens wordt het voorstel van de Mouvement Réformateur getoetst aan het juridische kader. Tenslotte wordt een alternatief voorstel onderzocht, namelijk de mogelijkheid van een concordaat.
1. INLEIDENDE IDEEËNGESCHIEDENIS
Op 22 en 23 februari 2003 hield de Mouvement Réformateur in Louvain-la-Neuve een congres met als titel “Engagement citoyen”. De werkgroep “Citoyenneté et Démocratie” van dit congres wees op de waardevolheid van het pluralisme. De maatschappij is een geheel van individuen en elk individu kan zijn eigen opvatting van het “goede leven” kiezen. De overheid dringt de individuen geen opvatting op, maar biedt enkel de mogelijkheid om door een democratisch debat consensus te bereiken. De overheid kan echter deze rol enkel vervullen indien alle burgers de politieke conceptie accepteren die de overheidsinstellingen beheerst. Daarom stelde de werkgroep voor om in de Grondwet de principes te bepalen die de door de overheid erkende organisaties of financieel ondersteunde partijen moeten respecteren.[2] Dergelijk voorstel kan een verregaande invloed hebben op het systeem van erkende erediensten.
Dezelfde politieke filosofie zet de Mouvement Réformateur ertoe aan om de laïcité van de overheid in de Grondwet op te laten nemen. De overheid mag geen religie of filosofische stroming begunstigen, maar moet de meningsvrijheid garanderen aan al haar burgers. Het principe van laïcité houdt in dat de overheid vanuit een dominante positie een gelijke, maar afstandelijke houding aanneemt ten opzichte van alle religies en filosofische overtuigingen: “(Le principe de la laïcité) ne signifie pas que l’Etat privilégie un courant philosophique ou religieux par rapport à un autre. Au contraire, la laïcité de l’Etat est une garantie de pluralisme des convictions philosophiques et religieuses. C’est l’autorité de l’Etat, supérieure à toute autre autorité, qui fait respecter la liberté de pensée et donc de conviction philosophique et religieuse au bénéfice de tous les citoyens. La laïcité de l’Etat, c’est l’Etat équidistant à l’égard de toutes les religions ou convictions philosophiques.”[3]
Het mag dan ook niet verwonderen dat de heer Maingain (FDF/MR) in de Kamer[4] en de heren Roelants de Vivier (MR) en Monfils (MR) in de Senaat[5] het Ontwerp van verklaring tot herziening van de Grondwet van de regering op identieke wijze trachtten te amenderen. Dit “humanisme démocratique” maakte ondanks de verwerping van het amendement deel uit van het programma van de MR voor de verkiezingen van 18 mei 2003[6].
2. VERHOUDING TUSSEN KERK EN STAAT
De verhouding tussen Kerk en Staat heeft betrekking op de relaties tussen de verschillende religieuze en levensbeschouwelijke gemeenschappen en hun leden enerzijds en de overheid anderzijds, alsook op de regelgeving die deze relaties beheerst.[7] Hierbij moet opgemerkt worden dat het begrip ‘Kerk’ niet enkel verwijst naar de christelijke godsdiensten, maar ook andere confessies en zelfs niet-confessionele levensbeschouwingen.[8] Het Belgische interne recht hanteert niet het begrip ‘Kerk’, maar wel de begrippen ‘eredienst/culte’ en ‘niet-confessionele levensbeschouwing’. ‘Eredienst’ werd door de auteurs van de Pandectes belges beschouwd als “l’hommage rendu par l’homme à la Divinité”, waarbij vooral “l’exercice public d’une religion” benadrukt wordt.[9] Steeds zal de rechter in concreto nagaan of het om een eredienst gaat.[10] De niet-confessionele levensbeschouwing werd pas in 1993 in de Grondwet opgenomen in het financieel getinte art. 181. Het onderscheid lijkt vooral een historisch karakter te zijn. Men kan zich immers vragen stellen bij de zinvolheid van het hanteren van een al te rigide onderscheid tussen ‘eredienst/culte’ en ‘niet-confessionele levensbeschouwing’.
De houding die de overheid aanneemt ten aanzien van de verschillende levensbeschouwingen is onderhevig aan de gehanteerde politieke opvattingen. Deze houding kan resulteren in een confessioneel systeem, een laïcaal systeem of een mengvorm waarbij samenwerking centraal staat.[11] Deze onderverdeling is archetypisch en moet gerelativeerd worden.
Ten eerste kan de overheid het beginsel van eenheid gebruiken. Zowel de volledige afwezigheid van religieuze neutraliteit is mogelijk, als de positieve religieuze neutraliteit zijn mogelijk. In het eerste geval heeft ofwel de staatsoverheid een overwicht op de religieuze overheid, ofwel de religieuze overheid een overwicht op de staatsoverheid. Soms wordt deze vorm gemilderd door de oprichting van nationale kerken en spreekt men van formeel confessionalisme. In het tweede geval ontstaat een ongelijke behandeling tussen de verschillende erediensten die aanwezig zijn in een bepaalde staat door een systeem van erkenning van erediensten. De positieve religieuze neutraliteit kan men niet alleen in België terugvinden, maar ook in Frankrijk.[12]
Ten tweede kan de overheid het beginsel van scheiding gebruiken. De staat zal zich actief verzetten tegen religieuze groeperingen of zich totaal onthouden. Deze religieuze onverschilligheid beheerst Frankrijk, uitgezonderd Alsace-Moselle.[13]
Ten derde kan een samenwerking ontstaan tussen de staat en de religieuze groeperingen door een systeem van overeenkomsten en verdragen (concordaten), die de belangen van de laatste behartigen. Dit samenwerkingsmodel kan variëren van het beginsel van eenheid tot het beginsel van eerder scheiding zoals in België.[14]
Volgens Ferrari is deze driedeling verouderd. De formele aspecten in de verhouding tussen Kerk en Staat worden te sterk benadrukt, terwijl de inhoudelijke aspecten niet voldoende aan bod kunnen komen.[15] Vandaar dat zowel België als Frankrijk bij twee van de drie systemen ondergebracht kunnen worden. De onderverdeling die op het eerste zicht zeer duidelijk lijkt, blijkt tegenstrijdigheden te generen.
3. VERHOUDING TUSSEN KERK EN STAAT IN BELGIË
3.1. DE GRONDWETTELIJKE POSITIE VAN DE EREDIENSTEN IN BELGIË
3.1.1. Discussie in het Nationaal Congres
In het Zuiden van Koninkrijk der Nederlanden ontstonden er twee oppositiebewegingen. De katholieke oppositie verzette zich tegen de godsdienst- en schoolpolitiek van Willem I. De liberale oppositie ijverde voor een parlementair regime, een rechtstreeks verkozen wetgevende macht, het principe van de ministeriële verantwoordelijkheid en de erkenning van een aantal vrijheden, waaronder de godsdienstvrijheid en de vrijheid van onderwijs. Rond aartsbisschop de Méan was een handvol mensen werkzaam die zochten naar een oplossing voor de gespannen houding tussen Kerk en Staat in de Nederlanden, “de School van Mechelen”. Deze groep vertrok van de theologische opvatting dat God niet twee Machten kan hebben ingesteld die tegenstrijdig waren met elkaar. De Kerk en Staat behoorden in de Nederlanden dus niet gescheiden te zijn, maar er moest een zekere band zijn tussen beiden. De Staat zou effectief moeten waken over het behoud van de cultusvrijheid en zo de cultussen beschermen.[16] De clerus zou ook een wedde moeten krijgen, die als een vergoeding werd beschouwd voor de aangeslagen goederen tijdens de Franse Revolutie.[17] Vanaf 1827 groeiden beide oppositiebewegingen naar elkaar toe en in 1828 was “de Unie der opposities” – het zogenaamde “monsterverbond” – een feit. Oorspronkelijk was slechts een kleine meerderheid voorstander van een afscheuring. Onder invloed van de Juli-revolutie in Parijs op 27 juli 1830 werden de gemoederen opgezweept en de beroerten in Brussel leidden tot dat wat niemand had verwacht, een politieke revolutie.[18]
Nadat het Voorlopig Bewind de onafhankelijkheid van België had uitgeroepen, vatte men aan met de uitbouw van de nieuwbakken staat. Het opstellen van een grondwet was één van de belangrijkste bekommernissen. Een commissie onder leiding van baron de Gerlache redigeerde een ontwerp van grondwet en de Belgen verkozen een grondwetgevende vergadering, het Nationaal Congres. In november 1830 verscheen in Leuven een anonieme brochure[19] van “de School van Mechelen”. Er stond te lezen dat de Grondwet de godsdienstvrijheid onaantastbaar moest maken. Tevens moest de vrijheid van eredienst gegarandeerd worden. Ook kwam men op voor de vrijheid van de cultus: alleen individuen mogen worden vervolgd indien ze in het kader van een cultus de publieke orde verstoren of strafbare feiten plegen. Daarenboven werd gepleit voor een gewaarborgde vrijheid van onderwijs en voor het beginsel van niet-inmenging in kerkelijke aangelegenheden, onder andere denkend aan de briefwisseling tussen de clerus en de Heilige Stoel. Bovendien werd een wedde voor clerici noodzakelijk geacht; deze wedde werd beschouwd als een rechtvaardige compensatie voor de inbeslagname van kerkelijke goederen. Op 17 december 1830 werd in het Nationaal Congres, waarin de meerderheid bestond uit katholieken, een brief voorgelezen van aartsbisschop de Méan, waarin hij de stellingnamen van de anonieme brochure diplomatisch parafraseerde. Toen het debat in het Nationaal Congres op 21 december 1830 aanving, werd al snel duidelijk dat de vrijheden niet alleen ten aanzien van het katholicisme zouden kunnen gelden, maar ook ten aanzien van de minderheidsgodsdiensten. De niet-confessionele levensbeschouwing kwam echter helemaal nog niet aan bod. Het ontwikkelde systeem van vrijheid zou echter vooral de katholieke godsdienst ten goede komen. De ruimdenkendheid van de katholieken had dus eigenlijk weinig om het lijf. De verspreiding van de andere godsdiensten was immers uiterst minimaal.Het is interessant om de uiteindelijke tekst van de Grondwet te vergelijken met de door de Méan voorgestelde tekst: de wensen van de aartsbisschop werden in grote mate ingewilligd door het Nationaal Congres.[20]
Zowel de katholieken als de liberalen deden bij het opstellen van de Grondwet toegevingen. De afschaffing van het capaciteitskiesrecht en de voorrang van het burgerlijk op het kerkelijk huwelijk zijn de voornaamste toegevingen langs katholieke zijde.[21] De liberalen aanvaardden dan weer de vrijheid van eredienst, de staatswedde voor de bedienaars van de eredienst en een staatstoelage voor onderhoud en oprichting van bidhuizen. Ook de vrijheid van onderwijs werd erkend.[22]
De eensgezindheid tussen liberalen en katholieken bleek echter bijzonder broos. Reeds op 22 december viel de liberaal Defacqz het ontwikkelde systeem van vrijheid aan. Hij pleitte voor een overwicht van de Staat op de Kerk “parce que la loi civile étant faite dans l’intérêt de tous, elle doit l’importer sus ce qui n’est que de l’intérêt de quelques-uns”. Door zijn scherp verzet werpt Defacqz een helder licht op sommige van de katholieke drijfveren. Het bleef echter een kleine minderheid van combatieve anti-katholieke liberalen die oppositie voerde. [23] Uiteindelijk aanvaarde het Nationaal Congres de vrijheid van eredienst en een bijzondere scheiding tussen Kerk en Staat.[24] [25]
3.1.2. Godsdienstvrijheid in de Belgische Grondwet
a. Art 19 G.W.
Dit artikel beschermt een aantal facetten van de godsdienstvrijheid. In de eerste plaats wordt de vrijheid van eredienst sensu stricto beschermd. Deze vrijheid moet ruim worden opgevat. Niet alleen het behoren tot een geloofsovertuiging, maar ook de overgang van het ene geloof naar het andere wordt beschermd. De term ‘eredienst/culte’ toont aan dat men vooral aandacht had voor externe aspecten. Een duidelijke definitie van ‘eredienst/culte’ is niet voorhanden, al heeft men dat wel betracht.[26] Het meest belangwekkende element is zeker en vast de uitwendig en publieke manifestatie van religieuze gevoelens.[27]
In de tweede plaats wordt de vrije openbare uitoefening door de Grondwet gewaarborgd. Art. 26, tweede lid bepaald echter dat bijeenkomsten in de open lucht aan de politiewetten onderworpen blijven. Dit artikel wordt door het Hof van Cassatie geïnterpreteerd als een algemeen beginsel dat toegepast kan worden op alle rechten en vrijheden zodra die op openbare wegen en pleinen worden uitgeoefend, zodat preventieve maatregelen mogelijk zijn. De Raad van State is een andere mening toegedaan en vindt dat, behalve voor vergaderingen in open lucht de Grondwet preventieve maatregelen verbiedt. Dit verbod geldt ook voor de uitoefening van de vrijheid van meningsuiting en de vrijheid van eredienst indien deze vrijheden op een openbare plaats uitgeoefend zouden worden.[28]
In de derde plaats waarborgt de art. 20 de vrijheid van meningsuiting, een recht dat ontegensprekelijk raakvlakken vertoont met de vrijheid van eredienst.
In de vierde plaats worden de grenzen van de godsdienstvrijheid in het laatste lid van art. 20 afgebakend. De vrijheden gelden enkel behoudens bestraffing van de misdrijven die ter gelegenheid van het gebruikmaken van die vrijheden worden gepleegd. Zo wordt het risico vergroot dat een conflict kan ontstaan tussen aspecten van een religieus systeem en de regels die behoren tot de openbare orde van de overheid indien het gedachtegoed van dat religieus systeem afwijken van het waardepatroon van de maatschappij.[29] Ofwel geeft de overheid dan de rechter de mogelijkheid om de grondrechten ten opzichte van elkaar af te wegen, ofwel acht de overheid bepaalde waarden zo belangrijk dat het strafrecht de afdwingbaarheid van deze waarden veilig moet stellen en zo de discussie eenzijdig te beëindigen.[30]
b. Art. 20 G.W.
De negatieve formulering van deze bepaling toont dat de positieve en de negatieve godsdienstvrijheid – het verbod van dwang om zich te bekennen tot een bepaalde levensbeschouwing – onlosmakelijk met elkaar zijn verbonden. Sinds oudsher worden in de rechtsleer een aantal concrete situaties gedetailleerd bestudeerd, dat is echter niet het onderwerp van deze studie.[31]
c. Art. 21 G.W.
Terwijl in art. 19 en 20 de godsdienstvrijheid – met een positief en een negatief aspect –abstract geformuleerd wordt, krijgt in art 21 de godsdienstvrijheid inhoudelijk gestalte. Het biedt religies de vrijheid om zich intern te organiseren zoals zij dat wensen. Deze vrijheid omvat drie concrete aspecten. Ten eerste heeft de Staat niet het recht zich te bemoeien met de benoeming of de installatie van de bedienaren van enige eredienst. Ten tweede de mogelijkheid voor bedienaars van de eredienst om vrij briefwisseling te houden met hun overheid. Ten slotte wordt ook gegarandeerd dat de akten van de kerkelijke overheid openbaar mogen worden gemaakt, maar met behoud van de gewone aansprakelijkheid inzake drukpers en openbaarmaking.[32]
Vrijheid van eredienst betekent dus niet alleen de eerbied voor de individuele overtuiging, maar ook het erkennen van de gemeenschapsvormen van een gelovige overtuiging. Het was mogelijk dat de Belgische grondwetgever zich enkel zou beperkt hebben tot de individuele vrijheid en –zoals in Frankrijk – zich niet ingelaten zou hebben met collectieve vormen. In België bezitten echter ook religieuze genootschappen over eigen fundamentele rechten.[33] Daar vloeit niet uit voort dat de overheid geen enkele vorm van controle mag uitoefenen.[34] Wel vloeit hier uit voort dat de profane rechter geen uitspraak mag doen over theologische vraagstukken. Toch kan men een evolutie vaststellen waarbij seculiere rechters zich meer en meer inmengen, ten nadele van de autonomie van religieuze organisaties.[35]
d. Art. 181 G.W.
Art. 181 is het laatste grondwetsartikel dat rechtsreeks van toepassing op de verhouding tussen Kerk en Staat en organiseert de financiering van de erediensten. Katholieke auteurs beschouwden de staatsbezoldiging van bedienaars van de eredienst als compensatie van de tijdens de Franse Revolutie genaaste kerkelijke goederen.[36] Liberale auteurs benadrukten vooral het sociale nut van de eredienst aan de bevolking.[37] Indien het sociale nut benadrukt wordt, dient de bedienaar van de eredienst de opgedragen taak werkelijk waar te nemen.[38] Door de grondwetsherziening van 1993 kreeg art. 181 een tweede lid, waardoor ook “morele lekenconsulenten” in aanmerking komen voor een staatswedde. Deze uitbreiding is weliswaar juridisch overbodig opdat de Staat lekenconsulenten een wedde zou kunnen toekennen, maar deze grondwettelijke erkenning benadrukt de maatschappelijke waarde van de vrijzinnigheid.[39]
Niet elke eredienst verkrijgt echter dergelijke financiering, art. 181, lid 1 geldt enkel en alleen voor de bedienaars van de erkende erediensten. De erkenning als eredienst van een geloofsovertuiging is niet steeds even vanzelfsprekend en heeft een aantal belangrijke rechtsgevolgen.
3.2. DE ERKENDE EN DE NIET-ERKENDE EREDIENSTEN
Het Nationaal Congres wou in de Grondwet geen privileges ten voordele van een eredienst toekennen, alle erediensten worden op voet van gelijkheid beschouwd. Ondanks deze principiële gelijkwaardigheid van alle erediensten zijn sommige erediensten door de overheid erkend. Deze erkenning is noodzakelijk opdat de bedienaars van de eredienst bezoldigd zouden worden door de overheid. Het Belgische systeem lijkt water en vuur met elkaar te willen verzoenen: er is een systeem van absolute gelijkheid tussen alle maatschappelijk aanvaarde godsdiensten, met een systeem van privileges voor de erkende erediensten.[40]
De erkenning gebeurt door of krachtens de wet. De wetgever moet zich hierbij onthouden van elk waardeoordeel en mag zich enkel laten leiden door de vraag of de bewuste eredienst aan de godsdienstige behoeften van (een deel van) de bevolking beantwoordt.[41] Bij de evaluatie dienen de grote christelijke kerken minstens impliciets als toetssteen. Schijnbaar atypische kenmerken van andere religies worden daardoor vaak negatief ingeschat, waardoor de erkenning niet plaatsvindt.[42]
De erkenning brengt ontegensprekelijk belangrijke voordelen met zich mee. Niet alleen verkrijgen de bedienaars van deze erediensten een wedde en nadien een pensioen, maar ook wordt de rechtspersoonlijkheid toegekend aan de openbare instellingen die zijn belast met het beheer van de goederen die voor de eredienst zijn bestemd.[43] Erediensten die niet erkend zijn mogen dan al genieten van de grondwettelijk beschermde godsdienstvrijheid, zij moeten echter een beroep doen op de vzw-techniek om rechtspersoonlijkheid te verwerven.[44]
Ook aan gemeenten en provincies worden, respectievelijk in de Gemeentewet en in de Provinciewet, verplichtingen opgelegd te voordele van de erkende erediensten. Een eerste reeks bepalingen zijn ten voordele van de bedienaars van de eredienst. Zij hebben betrekking op de huisvesting van de bedienaar van de eredienst. Een tweede reeks bepalingen handelen over het beheer van de goederen van de erkende erediensten. Zo worden financiële tekorten aangezuiverd en ontvangt men financiële steun voor de groeve herstellingen aan of de bouw van gebouwen bestemd voor de eredienst. Daarnaast zijn er nog een aantal suppletieve bepalingen in verband met aalmoezeniers in het leger en in de gevangenissen, zendtijd op de openbare omroep en de organisatie van godsdienstonderricht.[45]
De erkenning van bepaalde erediensten en de daar uit voortvloeiende toekenning van een aantal voordelen is een afwijking van het “beginsel van de gelijke behandeling van alle erediensten”. Toch neemt men aan dat het toekennen van voordelen aan erkende erediensten hieraan geen afbreuk doet. De Belgische grondwetgever beoogde immers geen absolute gelijkheid. Indien de overheid de steun zou beperken tot slechts één eredienst, dan zou men wel kunnen spreken van een inbreuk op het gelijkheidsbeginsel.[46] Het lijkt wel alsof er zich door de tijd heen een bijzondere vorm van het gelijkheidsbeginsel ontwikkeld heeft, waarop de ondertussen klassieke criteria van het Arbitragehof niet van toepassing zijn.
3.3. DE BURGERLIJKE RECHTER IN KERKELIJKE AANGELEGENHEDEN
3.3.1. Problematiek
De fundamentele regels die de verhouding regelen tussen de Belgische Staat en de Kerk kunnen we terugvinden in art. 19, 20, 21, 181 G.W.[47], maar ondanks de vele jurisprudentie en juridische geschriften is de problematiek van de burgerlijke rechter die gevraag wordt om tussen te komen in kerkelijke aangelegenheden gebleven.[48]
Het staat buiten kijf dat art. 21 de hoeksteen vormt van deze problematiek. De Staat mag zich niet bemoeien met de benoeming of de afzetting van de bedienaren van de eredienst. Evenmin mag de burgerlijke rechter zich niet bevoegd verklaren om een religieuze dissidentie te beslechten, de orthodoxie van een stelling te beoordelen of religieuze motieven naar waarde te schatten.[49] De rechter kan zich dus enkel uitspreken over de formele procedure. Maar deze controle is echter niet eenduidig. Men kan variëren van een louter formele toetsing van een kerkelijke beslissing tot een kwalitatief beoordelen van de kerkelijke procedure aan de hand van algemene rechtsbeginselen.[50]
3.3.2. Een formele toetsing
Aanvankelijk is de burgerlijke overheid heel terughoudend. De hoven en rechtbanken beperken hun controle van de kerkelijke beslissingen tot een louter formele toetsing. De rechterlijke macht beperkt zich in zaken van benoeming of afzetting tot de vaststelling dat dit gebeurde door de bevoegde kerkelijke overheid, zonder hierbij de wettigheid van deze beslissing te onderzoeken. [51]
Men kan echter een onderscheid maken tussen twee soorten formele toetsing en zo een minimale wijziging in de rechtspraak – in de lijn der verwachtingen – waarnemen. In principe zal de rechter alleen nagaan of de benoeming van een opvolger door de bevoegde kerkelijke overheid is gebeurd. Geleidelijk gaan de hoven en rechtbanken ook controleren of de beslissing tot herroeping door een bevoegde kerkelijke overheid is genomen.[52] Meer dan een formele toetsing blijft echter uitgesloten.
3.3.3. Een controle van de interne procedure
Deze klassieke leer wordt ter discussie gesteld met het arrest van 5 juni 1967, geveld door het Hof van Beroep van Luik. Het hof bevestigt weliswaar de klassieke 19e eeuwse leer en stelt dat de rechter mag nagaan of een bepaalde beslissing door de bevoegde kerkelijke overheid werd genomen, maar voegt hieraan toe dat deze kerkelijke overheid in alle onafhankelijkheid kan handelen overeenkomstig de eigen regels.[53] Tegen het arrest werd cassatieberoep ingesteld, maar het Hof van Cassatie verwierp het beroep met het arrest van 25 september 1975.[54] Het Hof van Cassatie deed echter geen uitspraak over het respecteren van de eigen regels, maar wees een middel af dat gericht was tegen een ten overvloede gegeven motief.[55] Een impliciete evolutie heeft plaatsgevonden. De louter formele controle wordt namelijk uitgebreider geïnterpreteerd: er vindt nu ook een controle van de interne procedure plaats, maar zonder dat deze als zodanig gekwalificeerd wordt.[56] In de rechtsleer werd echter reeds eerder gepleit voor het respecteren van de eigen regels.[57]
3.3.4. Op zoek naar kwaliteitsgaranties voor procedureregels
Het Hof van Beroep van Bergen zet met het arrest van 8 januari 1993 een nieuwe stap. De rechter mag niet alleen nagaan of de kerkelijke overheid bij het nemen van een beslissing conform de eigen regels heeft gehandeld, maar mag ook oordelen of deze regels voldoende (procedurele) garanties bieden. Hierbij verwijst het Hof naar algemene rechtsbeginselen zoals het recht van verdediging en het beginsel van tegenspraak.[58] De rechter zou zich dus niet beperken tot een louter formele toetsing van de bestreden beslissing en de controle van de kerkelijke procedure, maar zou ook een kwaliteitscontrole uitvoeren op deze procedure.[59]
Tegen dat arrest wordt echter cassatieberoep ingesteld en met het arrest van 20 oktober 1994 verbreekt het Hof van Cassatie het arrest van het Hof van Beroep van Bergen.[60] De vrijheid van eredienst (art. 21 G.W.) laat niet toe dat de hoven en rechtbanken onderzoeken of de kerkelijke procedure voldoende waarborgen biedt. Het Hof zich weliswaar niet uit of de maxime patere legem quam ipse fecisti[61] van toepassing is, maar argumenteert “dat de benoeming en de afzetting van de bedienaren van een eredienst alleen maar door de bevoegde geestelijke overheid kunnen geschieden overeenkomstig de regels van de eredienst[62], en, anderzijds, dat de godsdienstige discipline en rechtsmacht op die bedienaren van de eredienst alleen door dezelfde overheid overeenkomstig dezelfde regels kunnen worden uitgeoefend”. Hof expliciteert niet in hoeverre de toepassing van “de regels van de eredienst” onderworpen kunnen worden aan profaan rechterlijke controle, maar suggereert in ieder geval de mogelijkheid.[63] Met het arrest van 3 juni 1999, in dezelfde zaak, herhaalt het Hof – in verenigde kamers – zichzelf.[64]
De twee arresten van het Hof van Cassatie hebben er niet voor kunnen zorgen dat het onweer is gaan liggen. Een minderheid in de rechtsleer stelt dat de arresten niets verandert hebben en verdedigt de traditionele leer. Een andere minderheid is voorstander van een kwaliteitscontrole. De tussenpositie, die focust op de vraag of de kerkelijke overheden de interne regels gerespecteerd hebben en de maxime patere legem quam ipse fecisti toepassen, lijkt echter het meest voor de hand liggend.[65] [66]
3.4. KWALIFICATIE
In de Grondwet wordt nergens de verhouding tussen de overheid en de erkende erediensten of niet-confessionele levensbeschouwingen gekwalificeerd. Tijdens de voorbereidende werken werd weliswaar geopperd dat de verhouding tussen Kerk en Staat als een totale, volledige en absolute scheiding aangeduid moest worden.[67] Deze scheiding is in de praktijk nooit gerealiseerd. Elementen die enerzijds een scheiding aanduiden zijn bijvoorbeeld de afwezigheid van een staatsgodsdienst, de niet-toepasselijkheid van het canoniek recht in burgerlijke zaken, de laïcisering van de openbare ambten en ambtenaren, de niet toekenning van rechtspersoonlijkheid aan kerkelijke verengingen. Anderzijds worden de erkende erediensten door de overheid gefinancierd, wat duidt op samenwerking.[68] De rechtsleer is zich bewust van deze dubbelzinnigheid. De meeste auteurs trachten dan ook allerlei begrippen in te voeren om deze dubbelzinnigheid te verwoorden. Soms heeft men het over een “onderlinge onafhankelijkheid”, een “gematigde scheiding”, een “positieve neutraliteit”, een “welwillende neutraliteit”, een “regime sui generis”, een “beschermde vrijheid” of een “genuanceerde scheiding”. In ieder geval kan men stellen dat de verhouding in België tussen Kerk en Staat niet bestaat in een absolute scheiding en dat België geen état laïc is.[69]
4. VERHOUDING TUSSEN KERK EN STAAT IN FRANKRIJK
In tegenstelling tot België, wordt in Frankrijk de verhouding tussen Kerk en Staat wel gekwalificeerd in de Grondwet van 1958. De huidige Grondwet is echter niet de eerste tekst waarin het fenomeen religie behandeld wordt. De eerste belangrijke wet is ontegensprekelijk die wet van 9 december 1905 concernant la séparation des Eglises et de l’Etat. Voor de eerste keer werd in Frankrijkun régime de liberté religieuse ingevoerd.[70] De kwalificatie laïque werd echter pas ingevoerd in de Grondwet van 1946, waarbijlaïcité gedefinieerd kan worden alsle principe de la séparation de la société civile et de la religion[71].
4.1. DE WET VAN 9 DECEMBER 1905 CONCERNANT LA SÉPARATION DES EGLISES ET DE L’ETAT : EEN LAÏCITÉ DE COMBAT[72]
Voor Koubi heeft de wet van 9 december 1905 elke pertinentie verloren. Sinds het begin van de 20e eeuw heeft het principe van de laïcité immers fundamentele veranderingen ondergaan.[73] [74] Niettemin achten een aantal auteurs het praktisch belang van art. 2, waarin Frankrijk beschreven wordt als een République indivisible, laïque, démocratique et sociale, van de huidige Grondwet onderworpen aan de lezing van de wet van 1905.[75] In ieder geval biedt een bespreking van deze wet een relevante historische inleiding tot de laïcité à la française.
Voordat de wet van 9 december 1905 aangenomen werd, bevonden de katholieke[76], de protestantse en de israëlitische eredienst zich als erkende eredienst in een bijzondere positie. De bedienaars van de eredienst werden bezoldigd door de overheid, die ook deelnam aan hun benoeming. Duguit deinst er niet voor terug om het te hebben over véritables services publics. De niet-erkende erediensten étaient soumis à un régime de police d’autant plus arbitraire.[77]
Duguit haalt twee kritieken aan op deze uitwerking van de verhouding tussen Kerk en Staat. Aan de ene kant zijn de niet-erkende erediensten zijn onderworpen aan een volstrekte willekeurig stelsel. Zij zouden het recht moeten hebben om vrij hun eredienst uit te oefenen. Het stelsel van de erkende erediensten is la négation même de principe de liberté religieuse et du principe de l’Etat laïque en voor de gelovigen un empiétement intolérable de prince sur le domaine de la conscience religieuse.Aan de andere kant schendt het stelsel van erkende van de erediensten het principe de liberté religieuse omdat burgers gedwongen worden om geld uit te geven aan religies die zij niet praktiseren.[78]
De aanhangers van het principe van delaïcité hebben zich op het einde van de 19e eeuwen en in het begin van de 20e eeuw zowel politiek als filosofisch krachtdadig geprofileerd.[79] De formulering van Duguit lijkt niet meer te zijn dan een abstrahering van de strijd die zich heeft afgespeeld. Delaïcitéfrançaiseheeft vorm gekregen in de strijd die gevoerd werd door de Overheid tegen voornamelijk de katholieke Kerk.[80] De laïcité is in de eerste plaats en strijd geweest tegen het triomferende klerikalisme van de 19e eeuw. Er ontstond een ware polemiek tussen cléricauxen laïcs, die gekenmerkt werd door een haast ongekende heftigheid. Toch was het de bedoeling van de Republiek om met de wet van 9 december 1905 een compromis mogelijk te maken en zo een séparation à l’amiable te creëren.[81]
Het doel van de wet van 9 december 1905 is om godsdienstvrijheid mogelijk te maken, waarbij aan elk individu de vrije uitoefening van zijn of haar eredienst wordt verzekerd (art. 1) Hiertoe wordt een volkomen neutraliteit van de Staat noodzakelijk geacht, zodat geen enkele eredienst erkend kan worden en geen enkele eredienst een bezoldiging of subsidiëring kan verkrijgen (art. 2). Naast de bepalingen in verband met de erkenning en subsidiëring van erediensten, kunnen nog vier andere categorieën onderscheiden worden. Een aantal bepalingen handelen over de gebouwen en voorwerpen van de eredienst. Ook de rechtsovergang van kerkelijke goederen komt aan bod. Hiertoe werd in een vierde categorie bepalingen deassociations cultuelles in het leven geroepen. Een vijfde categorie handelt over de politie van de erediensten.[82]
De katholieke Kerk verzette zich echter sterk tegen deze wet en weigerde om deassociations cultuelles op te richten, maar de overheid greep niet in en liet de katholieken toe om de gebouwen van de eredienst te gebruiken zonder dat die daartoe gerechtigd waren. Langzaam maar zeker ontstond een meer serene relatie tussen de katholieke Kerk en de Staat.[83]
4.2. DECONSTITUTIONALISATIE VAN DE LAÏCITÉ[84]
De kwalificatie laïque was ook in 1946 nog altijd erg beladen.[85] Toch werd in art 1 van de Grondwet van 1946 afgekondigd dat Frankrijk een“République indivisible, laïque, démocratique et sociale” is. In de Grondwet van 1958 werd in het huidige art. 1[86] daaraan toegevoegd dat “elle assure l’égalité devant la loi de tous les citoyens sans distinction d’origine, de race ou de religion. Elle respecte toutes les croyances”.[87] De laïcité heeft haar polemisch karakter verloren en maakt deel uit van de grote vrijheden aangezien de vrijheid van meningsuiting, de godsdienstvrijheid en de vrije uitoefening van een eredienst er door beschermd worden[88]; “juridiquement, la laïcité, c’est la neutralité religieuse de l’Etat”[89].
Het Franse constitutionele recht neemt de godsdienstvrijheid van het individu in ogenschouw en niet de collectieve godsdienstvrijheid.[90] Niet de individuele godsdienstvrijheid is problematisch, maar wel de collectieve uitoefening van de eredienst. De Republiek garandeert weliswaar het pluralisme, maar door haar jacobijnse en centralistische tendensen worden intermediaire lichamen, minderheden of etnische, culturele of religieuze gemeenschappen niet (h)erkend.[91]
4.3.UNE SÉPARATION BIEN TEMPÉRÉE
Toch is de verhouding tussen Kerk en Staat veel complexer en diffuser dan dewet van 9 december 1905 en Franse Grondwet doen vermoeden. De wet van 9 december 1905 kadert in een radicaal antiklerikalisme, terwijl de huidige evenwichtsituatie nog het best omschreven kan worden als une séparation bien tempérée.[92] Terwijl de wet van 9 december 1905 de emanatie is van “la conception idéologique ou négative de la laïcité” bekrachtigen de grondwetten van 1946 en 1958 “la conception juridique ou positive de la laïcité”.[93]
Regelmatige en permanente subsidiëring van erediensten mag dan al niet mogelijk zijn (art. 2 van de wet van 9 december 1905). Toch kan de Franse staat activiteiten subsidiëren die plaatsvinden in een confessioneel kader, maar die van algemene aard zijn (bijvoorbeeld ziekenhuizen, liefdadigheidsinstellingen, enz.). De Franse overheid moet eveneens bepaalde religieuze diensten rechtstreeks ten laste nemen (bijvoorbeeld aalmoezeniers in openbare instellingen, tehuizen en gevangenissen). Vanzelfsprekend moet de Franse overheid ook instaan voor de bezoldiging van de bedienaars van erediensten wanneer zij diensten verstrekken aan de overheid (bijvoorbeeld gemeentesecretaris, enz.). Priesters en geestelijken kunnen ook beroep doen op sociale zekerheid.[94]
Een opmerkelijk kenmerk van de laïcité in Frankrijk is dat de scheiding tussen Kerk en Staat nooit volledig en rigide is geweest. De Republiek heeft steeds een welwillende neutraliteit aan de dag gelegd. Zelfs in 1905 waren er betrekkingen tussen de Republiek en de kerken.[95]
5. VOORSTEL MAINGAIN (FDF/MR)
5.1. EXEGESE
De opstellers van amendement nr. 2 lijken aan alles te hebben gedacht. Zij schetsen niet alleen de (rechts)historische aanknopingspunten van het principe van delaïcité, maar passen het beginsel ook toe en geven de gevolgen aan van de opname in de Grondwet. Niettemin staat de verantwoording bol van contradicties.
Met de eerste zin geven de auteurs de oorsprong aan de verhouding tussen Kerk en Staat in Frankrijk, “de doorslaggevende rol van de Staat ligt aan de oorsprong van de Franse laïciteit”. De auteurs onderscheiden drie etappes in “(de wens van de politieke overheid om) de individuen en de geledingen van het maatschappelijk leven te onttrekken aan de greep van de Katholieke Kerk”. De eerste etappe is blijkbaar niet de Franse Revolutie, die nochtans door Boyer als een ommekeer beschouwd wordt[96], maar hetrégime concordatairevan Napoleon. Het Concordaat van 1802 herbevestigt echter de belangrijke positie van de Katholieke Kerk in Frankrijk, al tonen deArticles organiquesdie Napoleon unilateraal toevoegde duidelijk de macht die de overheid uitoefende. De tweede etappe wordt volgens de auteurs gevormd door “de schoolwetten van de jaren 1880 die een cursus niet-confessionele moraal organiseren”. Onderwijsvrijheid en levensbeschouwelijke vrijheid zijn weliswaar nauw bij elkaar betrokken, maar gedurende de gehele 19e eeuw zou het concordatair regime verder blijven bestaan. Daaraan komt pas een einde met de wet van 9 december 1905concernant laséparation des Eglises et de l’Etat. Deze wet vormt dan ook de derde stap, die culmineert in de Grondwet van 1958: “la France est une République indivisible, laïque, démocratique et sociale”. De volstrekte scheiding tussen Kerk en Staat was een feit. Volgens Boyer waren het echter “les radicaux qui avaient fait de l’anticléricalisme un combat et un programme espéraient arracher à l’Eglise son pouvoir politique, matériel et même spirituel”[97].
De leden van het Nationaal Congres waren volgens de auteurs vrij godsdienstig en verkozen daardoor een liberale oplossing boven het sluiten van een concordaat met de Heilige Stoel. De formulering lijkt aan te geven dat de auteurs eenrégime concordataireverkiezen boven de vooruitstrevende en innovatieve oplossing van het Nationaal Congres.
De auteurs willen niet meer of minder dan de omzetting van het beginsel van de laïcité in de Belgische Grondwet. Ze zijn zich echter bewust van de bijzondere kenmerken van ons grondwettelijk systeem. Toch zou hun voorstel aansluiten bij het opzet van de Grondwet zoals zij door het Nationaal Congres werd geconcipieerd. Het Franse en Belgische systeem verschillen echter formeel helemaal van elkaar. De Franse wet van 9 december 1905 concernant la séparation des Eglises et de l’Etat is tot stand gekomen in een sfeer van antiklerikalisme, terwijl het Nationaal Congres een meer uitgebalanceerd en pragmatisch systeem ontwikkelde. Deze misvatting kan wellicht verklaard worden doordag het Belgische systeem geheel foutief beschouwd wordt als gebaseerd op “het principe van de wederzijdse niet-inmenging tussen de Staat en de (…) erkende en vertegenwoordigde kerken”. Een aantal elementen duiden weliswaar een scheiding aan, terwijl andere elementen dan weer de samenwerking benadrukken.
De auteurs geven in hun historische schets geven aan dat het Franse en het Belgische systeem van verhouding tussen Kerk en Staat een heel andere ontstaansgeschiedenis kennen en daardoor helemaal van elkaar verschillen. Even later poneren ze dat de omzetting van de laïcité geen problemen stelt aangezien het voorstel aan zou sluiten bij het opzet van de Grondwet van 1830 (sic). In tegenstelling tot wat de auteurs beweren heeft de inschrijving van de laïcité heeft tot gevolg dat de grondwettelijke beginselen wat de betrekking tussen de religies en de overheid betreft in het gedrag komen. Daarenboven zijn ze uit het oog verloren dat de hedendaagse Franse rechtsleer een minder formalistisch uitgangspunt inneemt en de verhouding tussen Kerk en Staat beschrijft als une séparation bien tempérée.[98]
In de “Inleidende ideeëngeschiedenis” heb ik reeds aangegeven dat het principe van laïcité voor de MR inhoudt dat de overheid vanuit een dominante positie een gelijke, maar afstandelijke houding aanneemt ten opzichte van alle religies en filosofische overtuigingen.[99] Het gaat kortom om een laïcité de combat. Dergelijke visie is een uiting van een negatieve religieuze neutraliteit: vanuit een scheiding pur sang moet de overheid levensbeschouwelijk neutraal zijn.
De Belgische overheid moedigt echter de vrije ontwikkeling van religieuze en institutionele activiteiten aan, zonder de onafhankelijkheid te beknotten.[100] De overheid maakt een pluralisme van levensbeschouwelijke activiteiten op actieve wijze mogelijk en handelt dus vanuit een positieve religieuze neutraliteit.[101] De opname van de laïcité in de Grondwet zou dus wel degelijk een wijziging betekenen ten opzichte van het huidige regeling.
5.2. HYPOTHETISCHE UITWERKING
De vraag welke wijzigingen zich in concreto zullen voordoen is tot nu toe onbeantwoord gebleven. De bedoeling van dit onderdeel is dan ook kort aan te geven welke gevolgen de opname van de laïcité in de Grondwet, als een uiting van een negatieve religieuze neutraliteit, zal teweegbrengen.
Indien de laïcité in art. 1 G.W. de verwoording zou zijn van een algemeen principe, zullen de regelingen van art. 19, 20, 21 en 181 G.W. slechts uitzonderingen zijn en als zodanig niet meer constituerend voor de verhouding tussen Kerk en Staat. Naast deze indirecte wijziging van de grondwettelijke bepalingen worden een aanzienlijk aantal wettelijke bepalingen – bijna steeds ten voordele van de erkende erediensten – op de helling gezet.
De erkenning van erediensten is weliswaar tegengesteld aan de negatieve religieuze neutraliteit, maar is verankerd in de Grondwet. Art. 181 G.W. vermeldt de erkenning echter enkel indirect in verband met de financiering. De betaling van de wedden en de pensioenen van de bedienaren van de eredienst en de morele lekenconsulenten zal de enige overgebleven consequentie zijn van de erkenning.
De huisvesting van de bedienaars van de eredienst (art. 255, 12° Nieuwe Gemeentewet) , de aanzuivering van negatieve saldo’s door gemeenten en provincies (art. 255, 9° Nieuwe Gemeentewet en art. 69, 9° Provinciewet), de gratis zendtijd op de openbare omroep (radio en televisie) en de bijstand door aalmoezeniers en morele lekenconsulenten in gevangenissen en in het leger zijn uitingen van de positieve religieuze neutraliteit en zijn niet verenigbaar met gepropageerde laïcité. Ook de tussenkomst bij de bouw of het herstel van gebouwen bestemd voor de eredienst is problematisch, al zal de restauratie en onderhoudspremies voor beschermde monumenten een belangrijke indirecte financiering blijven. [102]
De rechtspersoonlijkheid van openbare instellingen die belast zijn met het beheer van tijdelijke goederen (bijvoorbeeld de kerkfabrieken) wordt wellicht niet op de helling gezet. Men zou immers een parallellisme kunnen vaststellen met de associations cultuelles van de Franse wet van 1905, die ook kaderde in een negatieve religieuze neutraliteit. Het godsdienstonderricht en het onderricht in de niet-confessionele moraal in het openbaar onderwijs staan ook haaks op het principe van de laïcité. De Schoolpactwet van 29 mei 1959 werd echter verankerd in art. 24 de G.W.[103] en zou dus ook een uitzondering vormen ten opzichte van art. 1 G.W.. Een doorgedreven uitvoering van het principe van de laïcité, geïnspireerd door een negatieve religieuze vrijheid zou dus verregaande gevolgen kunnen hebben. De welwillende houding van de overheid is immers niet alleen terug te vinden in de Grondwet, maar ook in vele andere wetten en wordt weerspiegeld in een dagdagelijkse pragmatische mentaliteit.
6. HET CONCORDAAT, GEEN ALTERNATIEF
In de wandelgangen van de Apostolische Nuntiatuur te Brussel gaan stemmen op die pleiten voor het sluiten van een Concordaat tussen de Heilige Stoel en België. Zij hebben zich blijkbaar laten inspireren door de reeks concordaten die de Heilige stoel heeft gesloten met landen uit het vroegere Oostblok[104] en zich laten aanmoedigen door L’Osservatore Romano, waarin het verdrag van Lateranen tussen de Heilige Stoel en Italië (1929) beschouwd wordt als een modelverdrag voor andere concordaten[105]. Hier wil ik aantonen dat een dergelijk initiatief onverenigbaar is met de Belgische constitutionele rechtsorde en derhalve geen alternatief kan vormen voor het voorstel Maingain (FDF/MR).
6.1. DEFINITIE
Wagnon definieert een concordaat als “une convention conclue entre le pouvoir ecclésiastique (de Heilige Stoel[106]) et le pouvoir civil (de Staat) en vue de régler leurs rapports mutuels dans les multiples matières où ils sont appelés à se rencontrer. C’est un traité bilatéral, né de l’accord des volontés des deux parties, établissant une règle de droit qu’elles sont tenues en justice de maintenir et d’observer fidèlement.”[107] De reden waarom de Heilige Stoel graag concordaten sluit kunnen we ook terugvinden bij Wagnon. Deze vervolgt zijn definitie met: “(un concordat) est un acte solennel qui instaure entre les deux autorités appelées, à des titres divers, à régir les mêmes individus, un régime d’union, de concorde et de collaboration, hautement profitable non seulement aux sujets qui en bénéficient, mais encore à la religion tout comme à la société civile elle-même”.[108]Deze definitie ademt ontegensprekelijk de geest uit van het Rijke Roomse Leven, maar bevat niettemin een aantal meer dan waardevolle elementen. Het concordaat dat de eerste consul van de Republiek, Napoleon Bonaparte en paus Pius VII op 26 Messidor An IX (15 juli 1801) – Convention entre le Pape et le gouvernement français – kan getypeerd worden als “un traité diplomatique forgé par une modernité de laïcité naissante[109]”.Hoe het begrippenpaar “hautement profitable” ingevuld moet worden is dus niet altijd even duidelijk, het lijkt eerder een eventueel aangenaam gevolg te zijn dan een essentieel kenmerk. Wagnon definieert een concordaat niet als een internationaal verdrag. Nochtans kan men een concordaat als een internationaal verdrag kwalificeren. Art. 2, §1, al. a, Verdrag van Wenen inzake het verdragenrecht van 23 mei 1969 omschrijft een verdrag echter als “een internationale overeenkomst in geschrifte tussen Staten gesloten[110] en beheerst door het volkerenrecht (…)”. Gewoonterechtelijk wordt een verdrag echter gedefinieerd als elk akkoord dat gesloten wordt tussen twee of meer subjecten van het volkerenrecht, met de bedoeling rechtsgevolgen teweeg te brengen en dat beheerst wordt door het volkerenrecht.[111] Deze twee definities spreken elkaar niet tegen: art. 3, Verdrag van Wenen inzake het verdragenrecht van 23 mei 1969 duidt aan dat art. 2 slechts de werkingssfeer afbakent en vermeldt uitdrukkelijk de rechtskracht van internationale overeenkomsten gesloten tussen Staten en andere subjecten van volkerenrecht.[112] Een concordaat lijkt aan uiteindelijk beide definities te voldoen. Algemeen wordt immers aanvaard dat de Heilige Stoel volkenrechtelijke rechtspersoonlijkheid heeft.[113] Wagnon hoedt er zich echter voor om een concordaat als een internationaal verdrag te kwalificeren, al hebben een concordaat en een internationaal verdrag vanzelfsprekend veel met elkaar gemeen. De verschillen mogen dan al eerder theoretisch van aard zijn, voor Wagnon zijn ze onbetwistbaar. Een concordaat is namelijk een overeenkomst tussen een Staat en de Heilige Stoel, waarbij hetzelfde volk in ogenschouw genomen wordt. Een concordaat zou ook vooral gesloten worden met het oog op morele en religieuze belangen, niet met het oog op politieke en economische belangen.[114] De verschijnselen in onze wereld zijn echter slechte een flauwe afspiegeling van de Ideeën.
6.2. DE ONGRONDWETTELIJKHEID VAN EEN NIEUW CONCORDAAT
Toen op 24 september 1830 een administratieve commissie – reeds op 26 september omgevormd tot het Voorlopig Bewind – het bestuur van de afgescheiden provincies in handen nam, werd de Belgische Staat de facto gevormd. Wagnon stelt dat “(…) il faut nécessairement conclure à la cessation du concordat, sauf renouvellement de l’accord antérieurement en vigueur, soit par un arrangement semblable à celui de 1816-1817 entre Rome et La Haye, soit, plus simplement, en vertu d’une manière d’agir concluante du Saint-Siège et du gouvernement du nouvel Etat.” Het Voorlopig Bewind liet met het decreet van 16 oktober 1830 zelfs uitdrukkelijk verstaan het Concordaat van 1801 niet te willen heraanvatten. Door de godsdienstvrijheid in de Grondwet op te nemen (art. 19 en 20) heeft het Nationaal Congres impliciet aangegeven dat de Belgische Staat zich niet meer wil beroepen op de prerogatieven die het Concordaat van 1801 toekende aan de Franse Staat en dat het régime concordataire dus opgehouden heeft te bestaan.[115] De Raad van State heeft dit, wijzend op de onderlinge onafhankelijkheid van het burgerlijke en het kerkelijke gezag, in zijn adviespraktijk uitdrukkelijk bevestigd.[116] De verhoudingen en sommige afspraken tussen de overheid en de rooms katholieke Kerk zijn echter nog op het Concordaat van 1801 gebaseerd en soms wordt er zelfs nog in KB’s naar verwezen, terwijl de Articles organiques als wetten blijven voortbestaan voor zover zij niet onverenigbaar zijn met de Belgische grondwetsbeginselen.[117] Het sluiten van een concordaat zou dus een grondwetswijziging vereisen. Vervolgens zou de overheid gelijkaardige overeenkomsten moeten sluiten met andere (erkende) erediensten[118], zoniet zou men gewag kunnen maken van een ongeoorloofde discriminatie. Het sluiten van een concordaat, zonder een grondwetswijziging zou in ieder geval een schending van de Grondwet inhouden.
BESLUIT
De betekenis van de titel “Een paradoxale scheiding” zou nu volledig ontrafeld moeten zijn, niettemin is een verdere verduidelijking wellicht gewenst. Bij de bespreking van de verhouding tussen Kerk en Staat in België is gebleken de scheiding tussen beiden helemaal niet volledig is. Veel auteurs hebben deze verhouding trachten te kwalificeren en evenveel kwalificaties hebben het licht gezien. Steeds wordt dezelfde paradox in de rechtsleer blootgelegd: enerzijds wordt de godsdienstvrijheid benadrukt en worden alle erediensten als gelijk beschouwd, anderzijds heeft met een systeem van erkenning ontwikkelt met belangrijke financiële gevolgen. In Frankrijk is de verhouding tussen Kerk en Staat in grotere mate een uitgesproken scheiding.Ook het Voorstel Maingain wordt gekenmerkt door een paradox. Enerzijds vult men de verhouding tussen Kerk en Staat in vanuit een Frans geïnspireerde negatieve religieuze vrijheid en lijkt men eenlaïcité de combat te recreëren. Anderzijds zou naar eigen zeggen de voorgestelde grondwetswijziging aansluiten bij het opzet van het Nationaal Congres. Deze ongerijmdheid is slechts schijn. Men wil niet raken aan de bestaande bepalingen inzake de verhouding tussen Kerk en Staat en tegelijkertijd wil men een scheiding pur sang doorvoeren, waardoor uiteindelijk deze verhouding toch helemaal wijzigt. Een nog niet uitdrukkelijk geformuleerd voorstel om opnieuw een régime concordataire in te voeren is in het geheel niet verenigbaar met de Grondwet, van een paradox is er geen sprake.

He worked for the Office of Strategic Services in London and Germany during WWII and was a prosecuting attorney at the Nuremberg trials. He began his career as cocounsel for the LaFollette Senate Committee on unfair labor practices and later worked in the Office of Price Administration and the Office of Economic Warfare. After the Nuremberg trials, he worked for the State Department and the Foreign Service, was the economics counsel in the U.S. Embassy in London and in Leopoldville (now Kinshasa), Congo, and was a foreign policy adviser to the Science Advisory Committee under Presidents Nixon and Johnson.

Must the sins of America's past poison its hope for the future? Lately the American Left, withdrawing into the ivied halls of academe to rue the nation's shame, has answered yes in both word and deed. In Achieving Our Country, one of America's foremost philosophers challenges this lost generation of the Left to understand the role it might play in the great tradition of democratic intellectual labor that started with writers like Walt Whitman and John Dewey. How have national pride and American patriotism come to seem an endorsement of atrocities--from slavery to the slaughter of Native Americans, from the rape of ancient forests to the Vietnam War? Achieving Our Country traces the sources of this debilitating mentality of shame in the Left, as well as the harm it does to its proponents and to the country. At the center of this history is the conflict between the Old Left and the New that arose during the Vietnam War era. Richard Rorty describes how the paradoxical victory of the antiwar movement, ushering in the Nixon years, encouraged a disillusioned generation of intellectuals to pursue High Theory at the expense of considering the place of ideas in our common life. In this turn to theory, Rorty sees a retreat from the secularism and pragmatism championed by Dewey and Whitman, and he decries the tendency of the heirs of the New Left to theorize about the United States from a distance instead of participating in the civic work of shaping our national future. In the absence of a vibrant, active Left, the views of intellectuals on the American Right have come to dominate the public sphere. This galvanizing book, adapted from Rorty's Massey Lectures of 1997, takes the first step toward redressing the imbalance in American cultural life by rallying those on the Left to the civic engagement and inspiration needed for achieving our country.

Before leftist subjects of Her Majesty get snooty about American democracy, we might stop and wonder whose interests are served by our unshakable optimism about the past. The unguarded naiveties of Achieving Our Country are not quite as negligent as they look, and the book may well turn out to be one of the first signs of a long-delayed breaking of the ice in socialist politics following the end of the Cold War. The development of the atomic bomb by the Allies during the Second World War was one of the critical events in human history. The world today would be unimaginable if the Nazis had developed the bomb first and then used it on London.

The fact that history did not follow this dark and horrifying course has been the subject of a great deal of study. Before World War II, German science, especially physics, was preeminent. The Allies knew that Werner Heisenberg, one of the great scientific minds of the twentith century, was the head of the German nuclear effort. During the war, those working on the Manhattan project, many of whom had known Heisenberg and his colleagues before the war, were convinced that they were in a close race with the Germans to develop an atomic bomb. As the Allies advanced on Germany, the Alsos Mission, whose scientific director was Samuel Goudsmit, was sent to Europe to gain information about the progress of the German nuclear efforts. In France, at the University of Strasbourg, Goudsmit was able to examine the papers left behind by one of Heisenberg's colleagues, Carl Friedrich Von Wezsacker. Goudsmit discovered that the Germans had made little progress toward the construction of an atomic bomb. In fact, as it turned out, the Germans had made little progress obtaining a fission chain reaction and they never constructed a working nuclear reactor, which is the first step to producing plutonium for nuclear weapons.

Why, when the Germans seemed to have such a head start, did they make so little progress toward an atomic bomb? After the war, Von Wezsacker, who took a position at the Max Planck Institute, claimed that the German nuclear project made so little progress because their heart was not in it. They did not want Hitler to have the bomb. In fact, Von Wezsacker condemed the allies for constructing such a horrible weapon, when the Germans were, he claimed, only working on a nuclear reactor for power generation.

In Thomas Powers' 1993 book Heisenberg's War: The Secret History of the German Bomb, Powers makes a similar argument about Heisenberg's motivations. According to Powers' account, although Heisenberg was offered prestigious research positions in the United States, he chose to stay in Germany and share the "German fate". But he never really wanted Nazi Germany to have the atomic bomb.

After the Nazi defeat, ten physicists, including Heisenber, Von Weizsacker and Otto Hahn (who later won the Nobel prize as the co-discoverer of nuclear fission) were interned for six months at an English estate known as Farm Hall, located near Cambridge. By collecting the major players in German nuclear physics, the British and Americans kept them out of the hands of the Russians. They also made sure that until the atomic bomb was used, atomic information would be kept largely in American hands. While at Farm Hall the German scientists were well treated and probably ate better than their families back in Germany.

At Farm Hall each of them was assigned a prisoner-of-war batman to look after his needs. There was a tennis court and a piano for Heisenberg. the bedrooms were paneled and the food was good. What none of them seem to have realized, at least initially, was that the estate had been wired to record conversations.

Selected conversations were transcribed and circulated to British and American officials, including General Leslie Groves, who headed the Manhattan project. Although the existence of the Farm Hall transcripts had been known of for some time, it was not until early 1992 that they were finally made available to the public. In Hitler's Uranium Club Jeremy Bernstein provides an edited and annotated version of these transcripts. Bernstein also provides a detailed prologue, which discusses the history of the German bomb and his interpretation of the transcripts.

The Farm Hall transcripts, taken in conjunction with captured German documents, paints a very different picture than the one put forth by Von Weizacker and in Powers' Heisenber's War. The leading scientists in Germany had the opportinity to accept positions in America, before America entered the war. Those who remained in Germany fell into one of three catagories: they were Nazis, like Nobel Prize winner Johannes Stark, they could not leave, for what ever reason, or they were selectively blind to the regime around them and its implications. This did not mean that they were ignorant of Nazi terror and murder.

Heisenberg: During the war I had five calls for help in cases where people were murdered by our people. One was Soloman, Hoffman's son-in law. I could do nothing in his case as he had already been killed when I got the letter. The second one was Cousyns the Belgian cosmic ray man; he disappeared in a Gestapo camp and I couldn't even find out through Himmler's staff whether he was alive or dead. I presume he is dead too. Then there was the mathematician Cammaille; I tried to do something about him through Sethel but it was no good he was shot. Then from among the Polish professors there was a logistician with a Jewish name --- and then with the other Poles the following happened: his name was Schouder, a mathematician. He had written to me and I had put out feelers in order to see what could be done. I wrote to Scholz who had something to do with Poland. [...] I heard nothing more about Schouder and I have now been told that he was murdered.

The evidence of the Farm Hall transcripts is morally damning. Heisenberg and his colleagues knew about the murder going on around them, but they still worked on the German nuclear program. They did not build a nuclear weapon because they did not know how. Although Heisenberg was a gifted theoretical physicist, it was widely known at the time that he was a poor experimentalist and he had no experience with large scale scientific projects. Heisenberg and his colleagues also made several critical mistakes early in the project. For example, they tried using graphite as a nuclear moderator. However, the graphite was impure and absorbed neutrons, rather than slowing them down, which is necessary for the controlled nuclear fission in a reactor. Heisenberg also insisted on using reactor designs that worked well on the chalk board, but were experimentally a disaster. The Farm Hill transcripts and related documents do not point to any evidence that Heisenberg and his colleagues knew how to build a working reactor and but chose not to for moral reasons.

The American nuclear program consumed two billion dollars, which at that time was a vast sum of money. Tens of thousands of people worked on the design and manufacture of the first nuclear weapons, although a much smaller number actually know what they were building. In contrast the German effort was miniscule. In part this was because until the German army started to bog down on the Easter Front, they thought that the war was won. No "super weapons" were needed. Later in the war, the German scientists told officials that the construction of a nuclear bomb could not be completed in the near term. This was not because they were misleading their Nazi masters, but because this was what they actually believed. After the bomb was dropped on Hiroshima and it became clear that the Americans were far ahead of the Germans, Heisenberg and his colleagues were shocked.

Bernstein is one of the best popular science writers and I have enjoyed several of his books. He is a professor of physics at the Stevens Institute of Technology and he does a good job of explaining the technical problems encountered constructing a nuclear weapon. For the general reader, the most interesting part of Hitler's Uranium Club will be Bernstein's prologue. Although Bernstein has annotated and classified the Farm Hall transcripts, I found that they make tedious reading, and skimmed them. But for the serious student this book will be an important resource.

He pioneered in content analysis methods, virtually inventing the methodology of qualitative and quantitative measurement of communication messages (propaganda messages and newspaper editorials, for example).
His study of political and wartime propaganda represented an important early type of communication study. The word propaganda later gained a negative connotation and is not used much today, although there is even more political propaganda. Propaganda analysis has been absorbed into the general body of communication research.
He introduced Freudian psychoanalytic theory to the social sciences in America. Lasswell integrated Freudian theory with political analysis, as in his psychoanalytic study of political leaders. He applied Freud's id-ego-superego via content analysis to political science problems. In essence, he utilized intraindividual Freudian theory at the societal level.
He helped create the policy sciences, an interdisciplinary movement to integrate social science knowledge with public action. The social sciences, however, generally resisted this attempt at integration and application to public policy problem.

The first large-scale Asian–African or Afro–Asian Conference—also known as the Bandung Conference (Indonesian: Konferensi Asia-Afrika)—was a meeting of Asian and African states, most of which were newly independent, which took place on 18-24 April 1955 in Bandung, Indonesia. The twenty-nine countries that participated at the Bandung Conference represented nearly one-quarter of the Earth's land surface and a total population of 1.5 billion people, roughly 54% of the Earth's population at the time.[1][2] The conference was organised by Indonesia, Burma (Myanmar), Pakistan, Ceylon (Sri Lanka), and India and was coordinated by Ruslan Abdulgani, secretary general of the Indonesian Ministry of Foreign Affairs.

The conference's stated aims were to promote Afro-Asian economic and cultural cooperation and to oppose colonialism or neocolonialism by any nation. The conference was an important step toward the Non-Aligned Movement.

In 2005, on the 50th anniversary of the original conference, leaders from Asian and African countries met in Jakarta and Bandung to launch the New Asian-African Strategic Partnership (NAASP). They pledged to promote political, economic, and cultural cooperation between the two continents.

Background
The conference of Bandung was preceded by the Bogor Conference (1949). The Bogor Conference was the seed for the Colombo Plan and Bandung Conference. The 2nd Bogor Conference was held 28-29 December 1954.[3]

The Bandung Conference reflected what the organisers regarded as a reluctance by the Western powers to consult with them on decisions affecting Asia in a setting of Cold War tensions; their concern over tension between the People's Republic of China and the United States; their desire to lay firmer foundations for China's peace relations with themselves and the West; their opposition to colonialism, especially French influence in North Africa and its colonial rule in Algeria; and Indonesia's desire to promote its case in the dispute with the Netherlands over western New Guinea (Irian Barat).

Sukarno, the first president of the Republic of Indonesia, portrayed himself as the leader of this group of states, which he later described as "NEFOS" (Newly Emerging Forces).[4] His daughter, Megawati Sukarnoputri headed the PDI-P party during both summit anniversaries, and the President of Indonesia Joko Widodo during the 3rd summit was a member of her party.

On 4 December 1954 the United Nations announced that Indonesia had successfully gotten the issue of West New Guinea placed on the agenda of the 1955 General Assembly,[5] plans for the Bandung conference were announced in December 1954.[6]

Discussion

Major debate centered around the question of whether Soviet policies in Eastern Europe and Central Asia should be censured along with Western colonialism. A memo was submitted by 'The Moslem Nations under Soviet Imperialism', accusing the Soviet authorities of massacres and mass deportations in Muslim regions, but it was never debated.[7] A consensus was reached in which "colonialism in all of its manifestations" was condemned, implicitly censuring the Soviet Union, as well as the West.[8] China played an important role in the conference and strengthened its relations with other Asian nations. Having survived an assassination attempt on the way to the conference, the Chinese premier, Zhou Enlai, displayed a moderate and conciliatory attitude that tended to quiet fears of some anticommunist delegates concerning China's intentions.

Later in the conference, Zhou Enlai signed on to the article in the concluding declaration stating that overseas Chinese owed primary loyalty to their home nation, rather than to China – a highly sensitive issue for both his Indonesian hosts and for several other participating countries. Zhou also signed an agreement on dual nationality with Indonesian foreign minister Sunario.

Declaration
A 10-point "declaration on promotion of world peace and cooperation," incorporating the principles of the United Nations Charter was adopted unanimously:

Respect for fundamental human rights and for the purposes and principles of the charter of the United Nations
Respect for the sovereignty and territorial integrity of all nations
Recognition of the equality of all races and of the equality of all nations large and small
Abstention from intervention or interference in the internal affairs of another country
Respect for the right of each nation to defend itself, singly or collectively, in conformity with the charter of the United Nations
(a) Abstention from the use of arrangements of collective defence to serve any particular interests of the big powers
(b) Abstention by any country from exerting pressures on other countries
Refraining from acts or threats of aggression or the use of force against the territorial integrity or political independence of any country
Settlement of all international disputes by peaceful means, such as negotiation, conciliation, arbitration or judicial settlement as well as other peaceful means of the parties own choice, in conformity with the charter of the United Nations
Promotion of mutual interests and cooperation
Respect for justice and international obligations.[10]
The final Communique of the Conference underscored the need for developing countries to loosen their economic dependence on the leading industrialised nations by providing technical assistance to one another through the exchange of experts and technical assistance for developmental projects, as well as the exchange of technological know-how and the establishment of regional training and research institutes.

United States involvement
For the US, the Conference accentuated a central dilemma of its Cold War policy: by currying favor with Third World nations by claiming opposition to colonialism, it risked alienating its colonialist European allies.[11] The US security establishment also feared that the Conference would expand China's regional power.[12] In January 1955 the US formed a "Working Group on the Afro-Asian Conference" which included the Operations Coordinating Board (OCB), the Office of Intelligence Research (OIR), the Department of State, the Department of Defense, the Central Intelligence Agency (CIA), and the United States Information Agency (USIA).[13] The OIR and USIA followed a course of "Image Management" for the US, using overt and covert propaganda to portray the US as friendly and to warn participants of the Communist menace.[14]

The United States, at the urging of Secretary of State John Foster Dulles, shunned the conference and was not officially represented. However, the administration issued a series of statements during the lead-up to the Conference. These suggested that the US would provide economic aid, and attempted to reframe the issue of colonialism as a threat by China and the Eastern Bloc.[15]

Representative Adam Clayton Powell, Jr. (D-N.Y.) attended the conference, sponsored by Ebony and Jet magazines instead of the U.S. government.[15] Powell spoke at some length in favor of American foreign policy there which assisted the United States's standing with the Non-Aligned. When Powell returned to the United States, he urged President Dwight D. Eisenhower and Congress to oppose colonialism and pay attention to the priorities of emerging Third World nations.[16]

African American author Richard Wright attended the conference with funding from the Congress for Cultural Freedom. Wright spent about three weeks in Indonesia, devoting a week to attending the conference and the rest of his time to interacting with Indonesian artists and intellectuals in preparation to write several articles and a book on his trip to Indonesia and attendance at the conference. Wright's essays on the trip appeared in several Congress for Cultural Freedom magazines, and his book on the trip was published as The Color Curtain: A Report on the Bandung Conference. Several of the artists and intellectuals with whom Wright interacted (including Mochtar Lubis, Asrul Sani, Sitor Situmorang, and Beb Vuyk) continued discussing Wright's visit after he left Indonesia.[17][18]

Outcome and legacy
The conference was followed by the Afro-Asian People's Solidarity Conference in Cairo[19] in September (1957) and the Belgrade Conference (1961), which led to the establishment of the Non-Aligned Movement.[20] In later years, conflicts between the nonaligned nations eroded the solidarity expressed at Bandung.

Asian-African Summit of 2005
To mark the 50th anniversary of The Summit, Heads of State and Government of Asian-African countries attended a new Asian-African Summit from 20–24 April 2005 in Bandung and Jakarta. Some sessions of the new conference took place in Gedung Merdeka (Independence Building), the venue of the original conference. Of the 106 nations invited to the historic summit, 89 were represented by their heads of state or government or ministers.[3] The Summit was attended by 54 Asian and 52 African countries.

The 2005 Asian African Summit yielded, inter-alia, the Declaration of the New Asian–African Strategic Partnership (NAASP),[21] the Joint Ministerial Statement on the NAASP Plan of Action, and the Joint Asian African Leaders’ Statement on Tsunami, Earthquake and other Natural Disasters. The conclusion of aforementioned declaration of NAASP is the Nawasila (nine principles) supporting political, economic, and socio-cultural cooperation.

The Summit concluded a follow-up mechanism for institutionalization process in the form of Summit concurrent with Business Summit every four years, Ministerial Meeting every two years, and Sectoral Ministerial as well as Technical Meeting if deemed necessary.

Other anniversaries
On the 60th anniversary of the Asian-African Conference and the 10th anniversary of the NAASP, a 3rd summit was held in Bandung and Jakarta from 21–25 April 2015, with the theme Strengthening South-South Cooperation to Promote World Peace and Prosperity. Delegates from 109 Asian and African countries, 16 observer countries and 25 international organizations participated.[3]

Alexander McCarrell Patch Jr. was born in Fort Huachuca, Arizona on November 23rd, 1889, the son of then Captain A. M. Patch Sr. He attended Lehigh University before transferring to the United States Military Academy from which he graduated in 1913. General Patch served during the First World War but came to prominence as a commander during the Second World War. He formed the Americal Division which then served in Guadalcanal in relief of the 1st Marine Division. The XIV Corps under his command lead the final offensive against the Japanese forces there. Patch put down his ideas about leadership with the publication of an article in December, 1943 called “Some Thoughts on Leadership. In 1944, he was transferred to the European Theatre as commander of the 7th Army which landed in southern France in Operation Dragoon. In 1945, he took over the 4th Army. General Alexander M. Patch died of pneumonia on November 21st of the same year.

WILLIAM K. WYANT, a retired U.S. Army colonel, was a member of the news staff of the St. Louis Post-Dispatch Washington Bureau for nearly twenty-five years, covering the Pentagon, military affairs, and the White House and working on foreign assignments in India, Central America, and the NATO countries. During World War II he served as Secretary to the General Staff of the Seventh Army under General Alexander Patch.

Alexander Patch, the son of an army officer, was born in Fort Huachuca, Arizona, United States on 23rd November, 1889. He attended the West Point Military Academy and graduated in 1913 (75/93) and joined the 13th Infantry Regiment in Texas. He saw action in Mexico and in France during the First World War and by 1918 had reached the rank of lieutenant colonel.
After the war Patch studied at the Command and General Staff School at Fort Leavenworth and spent twelve years as Professor of Military Science and Tactics at Staunton. Promoted to colonel he was placed in charge of the recruitment camp at Camp Croft in North Carolina.
After the bombing of Pearl Harbor Patch was promoted to major general and sent to New Caledonia. As head of the 164th Regiment he joined Alexander Vandegrift and his US Marines on Guadalcana on 13th October 1942. Patch led a counter-offensive against the Japanese Army and secured victory on 9th February 1943.
In May 1943 Patch returned to the United States where he was placed in charge of the 4th Corps at Fort Lewis, Washington. He was also given responsibility for the Desert Training Center.
Patch returned to front-line duties when he was placed in charge of the US 7th Army which landed in France near Toulon on 15th August, 1944. His troops advanced up the Rhone Valley and captured the Saar on 15th March 1945. He then went on to force the surrender of German troops under the command of Hermann Balck.
In July 1945 Patch was promoted to lieutenant general and placed in command of the 4th Army based in San Antonio, Texas. Alexander Patch died of pneumonia on 21st November 1945.

IV International Congress for Modern Architecture

This document was produced as a result of the IV International Congress of Modern Architecture which took as its theme "the functional city" and focused on urbanism and the importance of planning in urban development schemes. The document includes urban ensembles in the definition of the built heritage and emphasizes the spiritual, cultural and economic value of the architectural heritage. It includes a recommendation calling for the destruction of urban slums and creation of "verdant areas" in their place, denying any potential heritage value of such areas. It condemns the use of pastiche for new construction in historic areas.
This is a retyped version of a translated document entitled The Athens Charter, 1933. J.Tyrwitt created the translation from French to English in 1943; the translation was thereafter published by Harvard University's Library of the Graduate School of design. I. THE CITY IN ITS REGIONAL SETTING

1. The city is only a part of the economic, social and political entity which constitutes the region.
2. Economic, social and political values are juxtaposed with the psychological and physiological attributes of the human being, raising problems of the relations between the individual and the community. Life can only expand to the extent that accord is reached between these two opposing forces: the individual and the community.
3. Psychological and biological constants are influenced by the environment: its geographic and topographic situation as well as its economic and political situation. The geographic and topographic situation is of prime importance, and includes natural elements, land and water, flora, soil, climate, etc.
4. Next comes the economic situation, including the resources of the region and natural or manmade means of communication with the outside world.
5. Thirdly comes the political situation and the system of government and administration.
6. Special circumstances have, throughout history, determined the character of individual cities: military defense, scientific discoveries, different administrations, the progressive development of communications and methods of transportation (road, water, rail, air).
7. The factors which govern the development of cities are thus subject to continual change.
8. The advent of the machine age has caused immense disturbances to man's habits, place of dwelling and type of work; an uncontrolled concentration in cities, caused by mechanical transportation, has resulted in brutal and universal changes without precendent [sic] in history. Chaos has entered into the cities.

II. THE FOUR FUNCTIONS OF THE CITY

A. Dwelling

9. The population density is too great in the historic, central districts of cities as well as in some nineteenth century areas of expansion: densities rise to 1000 and even 1500 inhabitants per hectare (approximately 400 to 600 per acre).
10. In the congested urban areas housing conditions are unhealthy due to insufficient space within the dwelling, absence of useable green spaces and neglected maintenance of the buildings (exploitation based on speculation). This situation is aggravated by the presence of a population with a very low standard of living, incapable of initiating ameliorations (mortality up to 20 per cent).
11. Extensions of the city devour, bit by bit, its surrounding green areas; one can discern the successive rings of development. This ever greater separation from natural elements heightens the harmful effects of bad sanitary conditions.
12. Dwellings are scattered throughout the city without consideration of sanitary requirements.
13. The most densely populated districts are in the least favorable situations (on unfavorable slopes, invaded by fog or industrial emanations, subject to flooding, etc.)
14. Low indensity developments (middle income dwellings) occupy the advantageous sites, sheltered from unfavorable winds, with secure views opening onto an agreeable countryside, lake, sea, or mountains, etc. and with ample air and sunlight.
15. This segregation of dwellings is sanctioned by custom, and by a system of local authority regulations considered quite justifiable: zoning.
16. Buildings constructed alongside major routes and around crossroads are unsuitable for dwellings because of noise, dust and noxious gases.
17. The traditional alignment of houses along the sides of roads means that good exposure to sunlight is only possible for a minimum number of dwellings.
18. The distribution of community services related to housing is arbitrary.
19. Schools, in particular, are frequently sited on busy traffic routes and too far from the houses they serve.
20. Suburbs have developed without plans and without well organized links with the city.
21. Attempts have been made too late to incorporate suburbs within the administrative unit of the city.
22. Suburbs are often merely an agglomeration of hutments where it is difficult to collect funds for the necessary roads and services.

IT IS RECOMMENDED

23. Residential areas should occupy the best places in the city from the point of view of typography, climate, sunlight and availability of green space.
24. The selection of residential zones should be determined on grounds of health.
25. Reasonable densities should be imposed related both to the type of housing and to the conditions of the site.
26. A minimum number of hours of sunlight should be required for each dwelling unit.
27. The alignment of housing along main traffic routes should be forbidden [sic]
28. Full use should be made of modern building techniques in constructing highrise apartments.
29. Highrise apartments placed at wide distances apart liberate ground for large open spaces.

B. Recreation

30. Open spaces are generally insufficient.
31. When there is sufficient open space it is often badly distributed and, therefore not readily usable by most of the population.
32. Outlying open spaces cannot ameliorate areas of downtown congestion.
33. The few sports fields, for reasons of accessibility, usually occupy sites earmarked for future development for housing or industry: which makes for a precarious existance [sic] and their frequent displacement.
34. Land that could be used for week-end leisure is often very difficult of access [sic].

IT IS RECOMMENDED

35. All residential areas should be provided with sufficient open space to meet reasonable needs for recreation and active sports for children, adolescents and adults.
36. Unsanitary slums should be demolished and replaced by open space. This would ameliorate the surrounding areas.
37. The new open spaces should be used for well-defined purposes: children's playgrounds, schools, youth clubs and other community buildings closely related to housing.
38. It should be possible to spend week-end free time in accessible and favorable places.
39. These should be laid out as public parks, forests, sports grounds, stadiums, beaches, etc.
40. Full advantages should be taken of existing natural features: rivers, forests, hills, mountains, valleys, lakes, sea, etc.

C. Work

41. Places of work are no longer rationally distributed within the urban complex. This comprises industry, workshops, offices, government and commerce.
42. Connections between dwelling and place of work are no longer reasonable: they impose excessively long journeys to work.
43. The time spent in journeying to work has reached a critical situation.
44. In the absence of planning programs, the uncontrolled growth of cities, lack of foresight, land speculation, etc. have caused industry to settle haphazardly, following no rule.
45. Office buildings are concentrated in the downtown business district which, as the most privileged part of the city, served by the most complete system of communications, readily falls prey to speculation. Since offices are private concerns effective planning for their best development is difficult.

IT IS RECOMMENDED

46. Distances between work places and dwelling places should be reduced to a minimum.
47. Industrial sectors should be separated from residential sectors by an area of green open space.
48. Industrial zones should be contiguous with railroads, canals and highways.
49. Workshops, which are intimately related to urban life, and indeed derive from it, should occupy well designed [sic] areas in the interior of the city.
50. Business districts devoted to administration both public and private, should be assured of good communications with residential areas as well as with industries and workshops within the city and upon its fringes.

D. Transportation

51. The existing network of urban communications has arisen from an agglomeration of the aids [sic] roads of major traffic routes. In Europe these major routes date back well into the middle ages [sic], sometimes even into antiquity.
52. Devised for the use of pedestrians and horse drawn vehicles, they are inadequate for today's mechanized transportation.
53. These inappropriate street dimensions prevent the effective use of mechanized vehicles at speeds corresponding to urban pressure.
54. Distances between crossroads are too infrequent.
55. Street widths are insufficient. Their widening is difficult and often ineffectual.
56. Faced by the needs of high speed [sic] vehicles, present the apparently irrational street pattern lacks efficiency and flexibility, differentiation and order [sic].
57. Relics of a former pompous magnificence designed for special monumental effects often complicate traffic circulation.
58. In many cases the railroad system presents a serious obstacle to well planned urban development. It barricades off certain residential districts, depriving them from easy contact with the most vital elements of the city.

IT IS RECOMMENDED THAT

59. Traffic analyses be made, based on accurate statistics, to show the general pattern of circulation in the city and its region, and reveal the location of heavily travelled [sic] routes and the types of their traffic.
60. Transportation routes should be classified according to their nature, and be designed to meet the rrquirements [sic] and speeds of specific types of vehicles.
61. Heavily used traffic junctions should be designed for continuous passage of vehicles, using different levels.
62. Pedestrian routes and automobile routes should follow separate paths.
63. Roads should be differentiated according to their functions: residential streets, promenades, through roads, major highways, etc.
64. In principle, heavy traffic routes should be insulated by green belts.

E. Legacy of History

IT IS RECOMMENDED THAT:

65. Fine architecture, whether individual buildings or groups of buildings, should be protected from demolition.
66. The grounds for the preservation of buildings should be that they express an earlier culture and that their retention is in the public interest.
67. But their preservation should no [sic] entail that people are obliged to live in unsalubrius [sic] conditions.
68. If their present location obstructs development, radical measures may be called for, such as altering major circulation routes or even shifting existing central districts - something usually considered impossible.
69. The demolition of slums surrounding historic monuments provides an opportunity to create new open spaces.
70. The re-use of past styles of building for new structures in historic areas under the pretext of assthetics [sic] has disastrous consequences. The continuance or the introduction of such habits in any form should not be tolerated.

III. CONCLUSIONS

71. Most of the cities studied present an image of chaos. They do not correspond in any way to their ultimate purpose: to satisfy the basic biological and physiological needs of their inhabitants.
72. The irresponsibility of private enterprise has resulted in a disastrous rupture of the equilibrium between strong economic forces on one side and, on the other, weak administrative controls and powerless social interests.
73. Although cities are constantly changing, their development proceeds without order or control and with no attempt to apply contemporary town planning principles, such as have been specified in professionally qualified circles.
74. The city should assure both individual liberty and the benefits of collective action on both the spiritual and material planes.
75. The dimensions of everything wi thin [sic] the urban domain should relate to the human scale.
76. The four keys to urban planning are the four functions of the city: dwelling, work, recreation (use of leisure time), transportation.
77. The city plan sould [sic] determine the internal structure and the interrelated positions in the city of each sector of the four key functions.
78. The plan should ensure that the daily cycle of activities between the dwelling, workplace and recreation (recuperation) can occur with the utmost economy of time. The dwelling should be considered as the prime center of all urban planning, to which all other functions are attached.
79. The speeds of mechanized transportation have disrupted the urban setting, presenting an ever-present danger, obstructing or paralyzing communications and endangering health.
80. The principle of urban and suburban circulation must be revised. A classification of acceptable speeds must be established. A reformed type of zoning must be set up that can bring the key functions of the city into a harmonious relationship and develop connections between them. These connections can then be developed into a rational network of major highways.
81. Town planning is a science based on three dimensions, not on two. This introduces the element of height which offers the possibility of freeing spaces for modern traffic circulation and for recreational purposes.
82. The city should be examined in the context of its region of influence. A plan for the total economic unit - the city-region - must replace the simple master plan of a city.
83. The city should be able to grow harmoniously as a functioning urban unity in all its different parts, by means of preordained open spaces and connecting links, but a state of equilibrium should exist at every stage of its development.
84. It is urgently necessary for every city to prepare a planning program indicating what laws will be needed to bring the plan to realization.
85. The planning program must be based on rigorous analytical studies carried out by specialists. It must foresee its stages of development in time andspace [sic]. It must coordinate the natural resources of the site, its topographic advantages, its economic assets, its social needs and its spiritual aspirations.
86. The architect engaged in town planning should determine everything in accordance with the human scale.
87. The point of departure for all town planning should be the single dwelling, or cell, and its grouping into neighborhood units of suitable size.
88. With these neighborhood units as the basis, the urban complex can be designed to bring out the relations between dwelling, places of work and places devoted to recreation.
89. The full resources of modern technology are needed to carry out this tremendous task. This means obtaining the cooperation of specialists to enrich the art of building by the incorporation of scientific innovations.
90. The progress of these developments will be greatly influenced by political, social and economic factors. . . [sic]
91. And not, in the last resort, by questions of architecture.
92. The magnitude of the urgent task of renovating the cities, and the excessive subdivision of urban land ownerships present two antagonistic realities.
93. This sharp contradiction poses one of the most serious problems of our time: the pressing need to regulate the disposition of land on an equitable and legal basis, so as to meet the vital needs of the community as well as those of the individual.
94. Private interests should be subordinated to the interests of the community.

Gustave Le Bon (Nogent-le-Rotrou, 7 mei 1841 – Parijs, 15 december 1931) was een Frans socioloog en psycholoog. Hij studeerde voor arts en oefende dat beroep ook vele jaren uit, en publiceerde daarnaast boeken en artikelen.

Zijn beroemdheid had hij te danken aan zijn in 1895 gepubliceerde werk La Psychologie des foules (De psychologie der massa's). Le Bon vertolkte hierin de opvatting, dat de individuele persoon, ook als hij lid is van een cultureel hoog ontwikkelde samenleving, in de massa zijn kritische vermogens verliest en zich dan affectief, en vaak ook primitief-barbaars, gedraagt. Een dergelijke massa kan al ontstaan bij een handjevol mensen. In massaal verband treedt de mens eerder op conform de intelligentie van de mínst intelligenten in de groep. In de massasituatie is de individuele persoon lichtgeloviger en ook vatbaar voor propaganda en massapsychoses. Dat heeft tot gevolg dat de massa vaak blind achter een leider aanloopt. Dit verschijnsel zou ook een verklaring zijn voor de populariteit van populistische partijen en demagogen en voor het optreden van volksgerichten en lynchpartijen.

Le Bon zag drie mechanismes die dit collectieve gedrag of deze groepsgeest bewerkstelligden:

anonimiteit, hierdoor voelt men zich minder verantwoordelijk voor het gedrag;
besmetting, emoties verspreiden zich door de massa als besmettelijke ziekte;
suggestibiliteit, in een massa accepteert men suggestie eerder als waar zijnde. Zo is de massa gemakkelijker te leiden door haar een vijandsbeeld voor te houden, dan door een logische gedachte uiteen te zetten.
De theorieën van Le Bon hebben veel invloed gehad op politici als Hitler en Mussolini.

Gustave Le Bon, né le 7 mai 1841 à Nogent-le-Rotrou et mort le 14 décembre 19311 à Marnes-la-Coquette, est un médecin, anthropologue, psychologue social et sociologue français.

Polygraphe, il est l'auteur de nombreux ouvrages dans lesquels il aborde le désordre comportemental et la psychologie des foules, dans son oeuvre principale Psychologie des foules parue en 1895.

Le Bon reste une personnalité controversée. Il véhicule une image pseudo-raciste, qui renvoie à « l’idéologie coloniale de son époque2 », liée à des tendances anticléricales, et compte au nombre des anti-colonisateurs.

Biographie

Gustave Le Bon en 1929.
Né en 1841 à Nogent-le-Rotrou, Eure-et-Loir, où son père, Jean Marie Charles Le Bon, est conservateur des hypothèques, Gustave Le Bon fait ses études au lycée de Tours. Il entre ensuite à la faculté de médecine de Paris, mais en sort sans avoir obtenu son diplôme3.

Il parcourt l’Europe, l'Asie et l'Afrique du Nord entre les années 1860 et 18804. Il écrit des récits de voyage, des ouvrages d’archéologie et d’anthropologie sur les civilisations de l’Orient4 et participe au comité d'organisation des expositions universelles.

En 1879, il fait une entrée remarquée au sein de la Société d'anthropologie de Paris qui lui décerne l’année suivante le prix Godard pour son mémoire « Recherches anatomiques et mathématiques sur les lois de variation du volume du cerveau et sur leur relation avec l’intelligence »5. En 1888, il démissionne et rompt tout contact avec cette société peu ouverte à ses approches psycho-sociologiques novatrices ; pour lui, « il n'y a pas de races pures dans les pays civilisés »6 et il entend le terme de « race », à l'instar de Taine ou Renan, comme un synonyme de « peuple », c'est-à-dire « un agrégat d'hommes appartenant au même milieu et partageant la même culture (langue, tradition, religion, histoire, coutumes vestimentaires, alimentaires, etc.) ».

« Les classifications uniquement fondées sur la couleur de la peau ou sur la couleur des cheveux n'ont guère plus de valeur que celles qui consisteraient à classer les chiens d'après la couleur ou la forme des poils, divisant, par exemple, ces derniers en chiens noirs, chiens blancs, chiens rouges, chiens frisés, etc.6 »

Au chapitre de la colonisation, Le Bon partage avec l’anthropologue Armand de Quatrefages une position hétérodoxe : le rôle de la puissance colonisatrice devait se borner à maintenir la paix et la stabilité, à prélever un tribut, à nouer ou à développer des relations commerciales, mais en aucun cas ne doit s’arroger le droit d’imposer sa civilisation à des populations réticentes7.

Son premier grand succès de librairie en sciences sociales est la publication en 1894 des Lois psychologiques de l'évolution des peuples, ouvrage qui se réfère aux lois de l'évolution darwinienne en les étendant de la physiologie à la psycho-sociologie.

L'année suivante, il écrit Psychologie des foules8, pour lequel il est félicité par Mussolini9.

Le Bon participe par la suite activement à la vie intellectuelle française. En 1902, il crée la Bibliothèque de philosophie scientifique chez Flammarion, qui est un vrai succès d'édition, avec plus de 220 titres publiés et plus de deux millions de livres vendus2 à la mort de Le Bon en 1931. À partir de 1902 il organise une série de « déjeuners du mercredin 1 » auxquels sont conviées des personnalités telles que Henri10 et Raymond Poincaré10, Paul Valéry, Émile Picard, Camille Saint-Saëns, Marie Bonaparte, Aristide Briand, Henri Bergson, etc. Il convie également à ces déjeuners la comtesse Greffulhe, icône de la Belle-Époque et inspiratrice de Proust pour À la recherche du temps perdu, avec qui il entretient une correspondance aussi abondante que familière11.

Il est inhumé au cimetière du Père-Lachaise (89e division).

Psychologie sociale
Gustave le Bon a étudié l'influence du déterminisme social et sociologique pour expliquer des comportements sociaux humains.

Dès ses premiers ouvrages, notamment La Vie, physiologie humaine appliquée à l'hygiène et à la médecine et L'Homme et les sociétés, leurs origines et leur histoire, Gustave le Bon recherche les causes des actions des hommes. Il détermine plusieurs causes: les causes biologiques, les causes émotionnelles, les causes rationnelles, les causes collectives et les causes mystiques. Cette analyse de la psychologie humaine va lui permettre d’interpréter des événements historiques et des faits divers restés jusque-là irrationnels et incompréhensibles.

D’une part, à une époque où la méthode devient importante, son « amateurisme » gêne ses contemporains tels que Emile Durkheim2, sans réelle incidence sur son début de carrière.

En 1895, il publie son oeuvre principale, Psychologie des foules, en s'inspirant des théories de la suggestion et l'imitation de Gabriel Tarde. En comparaison, sa théorie des comportements collectifs est plus ambivalente : selon Gustave Le Bon, les foules peuvent être manipulées et ont une capacité destructrice. Dans un même temps, elles sont aussi un moyen pour mener des changements politiques et sociaux12.

A partir de grands événements historiques, il décrit l'action des hommes par le seul fait qu'ils sont en groupe. Les principes qu'il expose dans cet ouvrage formeront les bases d'une nouvelle discipline scientifique : la psychologie sociale. Dans cet ouvrage, il expose une idée fondamentale : les foules sont composées d'asociaux et sont potentiellement « criminelles » comme le pensait Tarde, mais aussi capables d'amour, de sacrifice, d'héroïsme.

Influence
En 2010, Psychologie des foules est choisi par Le Monde et Flammarion comme l'un des « 20 livres qui ont changé le monde »13.

Les idées contenues dans Psychologie des foules jouèrent un rôle important au début du xxe siècle. Si les praticiens du totalitarisme, Mussolini, Hitler, Staline et Mao, passent pour s'être inspirés (ou plus exactement, avoir détourné les principes) de Gustave Le Bon14, beaucoup de républicains – Roosevelt, Clemenceau, Poincaré, Churchill, de Gaulle, etc. – s'en sont également inspirés.

Roosevelt avait désigné lui-même les convives qu'il désirait voir à ses côtés. Charles de Gaulle emprunte dans son livre à la gloire de « l'homme de caractère » (Le Fil de l'épée) l'essentiel des thèses de Le Bon, tendant notamment à considérer la suggestion comme le fait élémentaire et irréductible expliquant tous les mystères de la domination. Comme le père de la psychologie des foules, il entend profiter de la crise que l'autorité est réputée traverser pour en saisir l'essence. Cette crise correspond à une évolution par laquelle le principe d'autorité s'adapte à la modernité. Le diagnostic des deux auteurs est le même : l'autorité traditionnelle, attachée à la fonction, est en passe d'être remplacée par la suggestion pure, qui permettra aux chefs de se faire obéir des masses par la seule force de leur personnalité, de plus en plus indépendamment des cadres établis. « Pour de Gaulle comme pour Le Bon, la magie du social tient en un mot : le prestige. » Jean-Baptiste Decherf, De Gaulle et le jeu divin du héros. Une théorie de l'action15.

Dans sa préface, Mathieu Kojascha écarte l’idée que l’ouvrage ait pu faire le lit du fascisme et conclut : « Contribution définitive à la psychologie collective, à la compréhension du phénomène mystérieux qu’est la foule, Psychologie des foules de Gustave Le Bon doit aussi son immense succès au fait que ce personnage étonnant, intrigant, a su exprimer l’inquiétude de ses contemporains, leur perplexité devant certains aspects de la modernité. Perçu comme un texte fondateur de la psychologie sociale, ce livre est donc un formidable document d’histoire. » Ses découvertes lui permirent par ailleurs d'avertir dans un article intitulé De l’évolution de l’Europe vers diverses formes de dictature dès 1924 du fait que la montée du fascisme en Italie n'était pas un phénomène isolé mais risquait au contraire de s’étendre, par le même mécanisme d’un meneur de foules prenant, à la faveur d’événements violents, les rênes du pouvoir et les confisquant ensuite à son seul profit. Sur ce sujet, on se reportera aux ouvrages de Moscovici, Rouvier, Decherf et Korpa.

De fait, Le Bon n’a fait qu’analyser des phénomènes de croyance et de mobilisation collective qui peuvent servir à une rhétorique de conviction démocratique comme à une propagande totalitaire, mettant particulièrement en garde contre les risques de manipulation de l’opinion. Il est connu pour avoir été le premier penseur à avoir pointé du doigt le danger de la mystique de la supériorité de la race aryenne et condamné par avance la montée du nazisme : « L’Allemand moderne est plus dangereux encore par ses idées que par ses canons », écrit-il en 1918 dans Hier et demain. « Le dernier des Teutons reste convaincu de la supériorité de sa race et du devoir, qu’en raison de cette supériorité, il a d’imposer sa domination au monde. Cette conception donne évidemment à un peuple une grande force. Il faudra peut-être une nouvelle série de croisades pour la détruire. »

Ses travaux sur la psychologie des foules furent utilisés dans la première moitié du xxe siècle par des chercheurs en sociologie des médias tels que Hadly Cantril ou Herbert Blumer pour décrire les réactions des groupes face aux médias.

Sigmund Freud, malgré quelques réserves16, indiqua que « par l’accent qu’elle met sur le rôle inconscient de la vie psychique, la psychologie de M. Le Bon se rapproche considérablement de la nôtre »17 Dans son ouvrage Psychologie collective et analyse du moi, paru en 1921, Freud s’appuie sur une lecture critique de Psychologie des foules, il y mentionne les travaux de Le Bon notamment sur « les modifications du Moi lorsqu’il est au sein d’un groupe agissant », et écrit « je laisse donc la parole à M. Le Bon18. »

Dans une étude publiée par le journal anglais The Naval and military Gazette le 8 mai 1909, l'auteur s'exprime ainsi :

« On n'a jamais donné une meilleure définition de l'éducation que celle due à Gustave Le Bon : l'éducation est l'art de faire passer le conscient dans l'inconscient. Les chefs de l'état-major général anglais ont accepté ce principe comme la base fondamentale de l'établissement d'une unité de doctrine et d'action dans l'éducation militaire, dont nous avions si besoin. »

L'auteur de cette étude montre l'application des principes de Gustave le Bon dans les nouvelles instructions de l'état-major anglais : l'instinct et non la raison fait agir sur le champ de bataille, d'où la nécessité de transformer le rationnel en instinctif par une éducation spéciale. De l’inconscient surgissent les décisions rapides. « L'habileté et l'unité de doctrine doivent, par une éducation appropriée, être rendues instinctives ».

Etude des phénomènes révolutionnaires
Gustave Le Bon fournit les analyses psychologiques suivantes :

«

La première phase d'une révolution est consacrée à combattre les nécessités économiques et sociales qui régissent la vie des peuples. L'expérience prouvant bientôt que ces nécessités dominent les volontés, l'ancienne organisation reparaît sous des noms nouveaux. Ainsi se terminera nécessairement la révolution russe.
Les révolutions ne durent jamais longtemps parce qu'elles se heurtent bientôt au mur des nécessités économiques et sociales qui dominent le monde. Percevant alors l'impuissance des théoriciens, la foule se détourne d'eux. Avant d'arriver à cette dernière phase, bien des ruines sont accumulées. La Russie en fait aujourd'hui l'expérience.
D'après tous les enseignements de l'histoire des révolutions, l’extrémisme en politique a comme terminaison nécessaire soit la destruction de la civilisation, soit l'anarchie et la dictature.
Ce n'est pas d'une révolution, mais d'une transformation profonde des idées que résultent les réformes durables.

Concernant la Révolution française :

« …Les blessures d’amour-propre sont celles dont le souvenir s’efface le moins. Le Tiers-État en avait supporté beaucoup. À une réunion des États Généraux de 1614 où ses représentants s’étaient vus obligés de rester à genoux tête nue, un membre du Tiers ayant osé dire que les ordres étaient comme trois frères, l’orateur de la noblesse répondit : « qu’il n’y avait aucune fraternité entre elle et le Tiers, que les nobles ne voulaient pas que les enfants de cordonniers et de savetiers les appelassent leurs frères ». »

« La soif d'inégalité semble un besoin irréductible de la nature humaine. On sait avec quelle ardeur les Conventionnels échappés à la guillotine sollicitaient de Napoléon des titres nobiliaires. Le rêve égalitaire qui les avait conduits à tant de massacres n'était donc en réalité qu'un violent désir d'inégalité à leur profit. L'histoire n'a pas encore cité, d'ailleurs, de pays où régnât l'égalité. »

Etude des civilisations
Le Bon ne soutient pas la théorie d’une hiérarchisation des civilisations, mais admet des différences au niveau des stades de développement, et soutient la théorie du biologiste darwinien allemand Ernst Haeckel (1834-1919)2. Il consacre un gros volume illustré à la Civilisation des Arabesn 2, et il envisageait l’éveil à venir d'une Afrique encore sous-développée au début du xxe siècle. Après une mission aux Indes, il publie, en 1887, un autre ouvrage majeur, Les Civilisations de l’Inde2. Il se différencie en cela fortement d'Arthur de Gobineau et dénonce à plusieurs reprises dans ses œuvres le « mythe de la race aryenne », mettant en garde contre les visées suprémacistes du national-socialisme dès 1924.
La Première Guerre mondiale
Gustave Le Bon a prédit que la Première Guerre mondiale serait meurtrière car il s’agirait de guerre de conscrits et non plus de professionnels. Ainsi dans Psychologie du socialisme (1898), il écrivait que « les prochaines luttes entre nations seront de véritables luttes pour l'existence ne pouvant se terminer que par l'écrasement complet de l'un des combattants. » Ses idées sur la psychologie ont influencé l'École de guerre, chargée de préparer les officiers. Le Bon a aussi analysé le conflit dans des livres comme Premières conséquences de la guerre (1917).

Voici ce qu'écrit Gustave Le Bon au lendemain de Première guerre mondiale:

« Les peuples ne se résignent pas à la défaite quand ils se croient supérieurs à leurs vainqueurs. Une tentative de revanche germanique peut donc être considérée comme un des plus sûr événements de la future Histoire. »

Redécouverte à l'époque moderne

Il a été redécouvert en France grâce à Serge Moscovici lors du cinquantenaire de la mort du sociologue en 1981 avec L'Âge des foules qui traite des précurseurs de la psychologie sociale, à savoir Gustave Le Bon, Gabriel Tarde et Sigmund Freud. Pour Moscovici, Le Bon (en qui il voit le « Machiavel des sociétés de masse ») est celui qui, le premier, a saisi l'importance du rôle (potentiellement destructeur) des masses dans le processus historique et en a esquissé la typologie.

En 1977, Catherine Rouvier, après son mémoire soutenu en 1976 avec Roger-Gérard Schwartzenberg à l'université de Paris 2 Panthéon Assas sur « la personnalisation du pouvoir en France de 1875 à 1958 » faisait porter ses recherches en histoire sur la psychologie politique sur Le Bon et montrait que ce dernier était en réalité mal compris car victime d'une confusion courante entre masses et foules.

En effet, l'apport de Le Bon à la psychologie sociale ne concerne nullement les masses — concept très général peu susceptible d'une approche expérimentale. Son véritable sujet d'étude est la foule, définie comme une réunion momentanée d'individus soumis à une émotion forte à la suite d'un événement et/ou d'un discours ou d'une image provoquant la peur, la haine, ou, au contraire, l'enthousiasme et l'amour. Ces découvertes de le Bon s'inscrivent en effet clairement dans le débat qui agite les historiens du xixe siècle sur les causes de la violence et du caractère subit des révolutions, celle de 1789, bien sûr, mais aussi celles de 1830, 1848 et 1870. Cela est donc bien distinct de ce qui sera développé plus tard par Wilhelm Reich, par exemple sur « la psychologie de masses du fascisme ».

L'état de suggestibilité de la foule est très précisément décrit par ce médecin passionné par les expériences en tout genre, de Charcot sur la guérison de l'hystérie par l'hypnose à la Salpetrière ainsi que par la technique (au départ fondée sur l'hypnose) de la guérison des névroses par Sigmund Freud, avec lequel il correspondit grâce à leur amie commune Marie Bonaparte.

Le concept de horde chez Freud est, du reste, à rapprocher — mais non à confondre — avec celui de foule chez Le Bon. Dans les deux cas, est décrit le phénomène du meneur, qui est celui qui va répondre à l'expectative du groupe, foule ou horde. Mais tandis que la horde est un groupe soumis en permanence aux directives de son chef, la foule n'est éminemment suggestible et donc vulnérable à tout mot d'ordre exprimé avec force que pendant le temps que dure l'excitation due à l'évènement — ou à la mise en scène fictive d'un évènement.

L'intérêt majeur de cette théorie, dite de la « psychologie des foules », est précisément d'introduire, dès la fin du xixe siècle, dans la réflexion politique le concept de plus en plus utilisé en ce début de xxie siècle de quotient émotionnel.

Comme beaucoup de savants provenant des sciences de la nature, il a émis sans précautions oratoires des idées sur la psychologie collective qui parurent choquantes :

la tendance des groupes à la soumission à l'autorité se trouve démultipliée dès lors que des événements sont théâtralisés, orchestrés et utilisés par des leaders pour pousser à l'action un groupe, qui, alors, devient « foule ».
Ce groupe peut être les participants à une assemblée générale, à une manifestation, mais aussi à un jury d'Assises ou à toute autre forme institutionnelle de réunion.
Voilà qui ne pouvait que déplaire à des sociologues qui, comme le notera plus tard Pierre Bourdieu, ont tendance à légitimer parfois au-delà du raisonnable leur objet d'études : la classe politique — qui, pourtant, était confrontée à cette époque au spectacle délétère de débats à l'Assemblée nationale, où, parfois, on criait « À mort ! » (contre Ferry dans l'affaire du Tonkin, par exemple).

Les idées de Le Bon se sont trouvées largement vérifiées, ainsi la tendance des masses à se plier à la servitude volontaire. « Le fait que le régime totalitaire, écrit Hannah Arendt à ce sujet, malgré l’évidence de ses crimes, s’est appuyé sur les masses, est profondément troublant. » (Les origines du totalitarisme, Éditions du Seuil, 1950).

Le Bon peut aussi être considéré comme le précurseur de la notion de « public », aujourd'hui utilisée en sociologie des médias. En effet, une « foule », au sens psycho-sociologique du terme, peut ne pas être réunie physiquement (ainsi les téléspectateurs ou les internautes) ; ses membres forment, à un moment donné, une communauté qui participe à une même activité et partage les mêmes émotions. Mort en 1931, il a pourtant pu mesurer l'impact futur que seraient appelés à avoir les mass-media : « Avec les moyens actuels de publicité, consignait-il en 1924, une opinion ou une doctrine peut être lancée comme un produit pharmaceutique quelconque. »

John Stuart Mill (20 mei 1806 – 8 mei 1873) was een Engels filosoof en econoom, en de meest invloedrijke vrije denker van de 19e eeuw. Hij was een voorstander van het utilitarisme, de ethische theorie die voorgesteld werd door zijn peetvader Jeremy Bentham.

John Stuart Mill werd geboren in zijn vaders huis in Pentonville, Londen, als de oudste zoon van James Mill. Hij kreeg zijn onderwijs van zijn vader, met advies en assistentie van Jeremy Bentham en Francis Place. Hij kreeg een strenge opvoeding en werd nadrukkelijk afgeschermd van andere jongens van zijn leeftijd. Zijn vader, een navolger van Bentham, had als zijn specifieke doel om een genieus intellect te creëren dat de doelen en uitvoering van het utilisme zou doen verder leven na de dood van Bentham en hemzelf.

Tegen de tijd dat hij drie was kon hij het Griekse alfabet opnoemen, en toen hij acht werd had hij Aesopus' 'Fabels' gelezen en wist hij van Plato. In 1818 begon hij aan een studie logica en het jaar erop kreeg hij te maken met politieke economie.

Hij publiceerde zijn eerste belangrijke boek in 1842, The system of logic. Een van de belangrijkste theorieën is het beginsel van causaliteit – Als A altijd door B wordt gevolgd, kan worden verondersteld dat dit in de toekomst ook altijd zo zal zijn.

In 1869 publiceerde hij Subjection of Women, waarin hij de vrouwenrechten verdedigde. Hij was dan al vier jaar parlementslid waar hij eveneens ijverde voor het vrouwenkiesrecht en de vooruitstrevende liberalen steunde. Zijn vrouw Henriëtte, die in 1858 stierf, zou het boek geschreven hebben, maar op haar naam mocht het niet worden uitgegeven. Tot op de dag van vandaag staat het boek officieel op naam van John Stuart Mill.

Né à Bruxelles en 1783, mort à Paris en 1859, Jean-Guillaume-César-Alexandre-Hippolyte de Colins de Ham était une figure haute en couleur. Aristocrate de naissance, soldat de carrière dans la Grande armée, vétérinaire, médecin, planteur de café et propriétaire d'esclaves à Cuba, philosophe et même théologien quoique rationaliste et soit-disant athée, il fut, sur ses vieux jours l'un des penseurs les plus originaux du siècle dernier, auteur de quelque quarante volumes dont près de la moitié furent édités de son vivant. Dans cette masse, trois titres s'imposent : celui de L'économie politique source des révolutions et des utopies prétendues socialistes dont les trois premiers volumes sortirent de presse en 1856-1857, celui de la Science sociale dont les cinq premiers volumes parurent en 1857, et celui de La justice dans la science, hors l’Église et hors la révolution, réfutant Proudhon, dont les trois tomes furent publiés en 1860. Mais il importe de relever que les manuscrits des deux premiers ouvrages que nous venons de citer datent des années 1840-1845, époque à laquelle ils circulaient parmi les disciples de Colins. Le premier d'entre eux fut l'ancien révolutionnaire et membre du Gouvernement provisoire de Belgique, Louis De Potter, né à Bruges en 1786 et mort à Bruxelles en 1859, surtout connu par son œuvre d'historien du christianisme, qui dès 1840 entreprit la publication de brochures puis de livres exposant le socialisme rationnel de son ami, parmi lesquels nous retiendrons les deux volumes des Etudes sociales datant de 1841-1842, La justice et sa sanction religieuse, parue en 1846, et le Catéchisme social publié en 1850. Son fils, Agathon De Potter, né en 1827 à Bruxelles et décédé dans cette même ville en 1906, avait été élevé dans le socialisme rationnel auquel Colins lui-même acheva de le convertir en 1846, comme l'atteste d'ailleurs l'un des textes ci-après. Ayant reçu une formation de médecin, le Dr Agathon De Potter, qui, dès 1858, s'était affirmé comme un habile polémiste en rendant compte dans la Revue trimestrielle de Bruxelles des neuf volumes que Colins avait fait paraître l'année précédente, publia l'essentiel de son œuvre dans la Revue du socialisme rationnel qu'il dirigea avec l'ancien sous-officier français Frédéric Borde, de 1875 à sa mort. Parmi ses ouvrages séparés, citons cependant une Logique, datant de 1866 et une Économie sociale datant de 1874.

Présenté ainsi, le socialisme rationnel a souvent été incompris car interprété dans une perspective étatiste, interventionniste et dirigiste qui lui est foncièrement étrangère. Colins aurait d'ailleurs pu faire sienne la parole de Fourier: «Tout ce qui est fondé sur la contrainte est fragile et dénote une absence de génie.» En matière économique, le socialisme rationnel n'est autre qu'un libéralisme absolu délivré des féodalités financières. En effet, il limite très étroitement le rôle de l'État qui se voit interdire toute activité économique de production, il est anti-interventionniste car axé tout entier sur le principe de la libre concurrence et il est anti-dirigiste car il ne reconnaît d'autre autorité que la raison. Il vise essentiellement à assurer constamment le maximum de liberté à tous les hommes, ce qui implique nécessairement:



1. Que le paupérisme moral soit anéanti par la démonstration de l'immatérialité des âmes et de la réalité de l'ordre moral; que par conséquent le dévouement soit socialement considéré comme relevant de la raison et non de la sottise; et que cette vérité soit sociale-ment inculquée à tous les mineurs indistinctement, par l'éducation et l'instruction.





2. Que le paupérisme matériel soit anéanti par la collectivisation du sol, source passive originaire de toute richesse, et de la majeure partie des capitaux mobiliers accumulés par les générations passées, donc sous la souveraineté de la force, collectivisation qui pour être réelle doit être le fait d'une société devenue effectivement l'association de tous et non plus des seuls forts.





3. Que la société soit seule chargée de l'éducation et de l'instruction pour développer au maximum l'intelligence de tous les individus afin d'établir entre eux une concurrence réellement libre, de manière que le bien-être de chacun soit autant que faire se peut la mesure de son travail, celui des inaptes au travail étant pris en charge par la collectivité au nom de la fraternité.





4. Que la société s'abstienne désormais de concurrencer quiconque dans la production, mais qu'elle garantisse la libre concurrence généralisée en proscrivant absolument toute association de capitaux, en attribuant à chaque individu une dot sociale (à titre de prêt) à son entrée dans la vie active, et en affermant la terre, divisée rationnellement en lots agricoles et industriels, aux plus offrants et derniers enchérisseurs individuels ou collectifs, les associations de travailleurs étant bien sûr autorisées par la raison .
